미국의 농축산물 테러 방지 법제와 우리나라의 테러방지법에 관한 연구

테러는 사회재난들 가운데 하나로 분류될 수 있는데, 우리 헌법 제34조 제6항에서는 각종사회재난과 자연재난, 그리고 그 위해로부터 국민들을 보호하기 위하여 노력해야 할 국가의 의무를 명시하고 있다. 따라서 테러로부터 국민의 생명과 재산을 보호하고 국가의 안보를 확보하는 것은 대한민국 정부의 헌법적 의무라고 할 수 있겠다. 이러한 헌법적 의무를 구체적으로이행하기 위하여 제정된 테러방지법이 지난 2016년 이래로 시행 중에 있다. 특별히 국제 테러단체 등에 의한 테러 위협이 날로 고조되어 오고 있는 현실을 감안할 때에 이는 시의적절하면서도적실성 있는 입법이라고 생각한다. 이처럼 현재 시행되고 있는 테러방지법이 민의를 대의하는국회에서 통과되어 입법이 이루어진 이상 이제는 행정부 차원에서 이를 빈틈없이 집행하기 위한구체적 종합대책 마련에 집중해야 할 때라고 본다. 또한 이러한 종합대책의 실효성을 제고하기위한 법적⋅제도적 관점에서의 보강 방안 구상에도 주력해야 할 시기라고 생각한다. 따라서본 논문에서는 이러한 법적⋅제도적 관점에서의 보강 방안으로서 ‘농축산물 테러(agroterrorism) 에 대한 개념의 추가’를 제시하고 있다. 미국의 「2002년 제정 공중의 건강안전 및 생물테러 대비⋅대응 법률」이나 「2002년 제정 농업분야 생물테러방지법」과는 달리, 우리나라의 경우 이러한농축산물 테러에 대한 고려가 테러방지법의 입법 과정에서 충분히 이루어지지 않았기 때문이다. 하지만 농축산물 테러의 경우, 국제 테러단체 등이 마음먹기에 따라 언제든지 어렵지 않게 일으킬 수 있는 테러의 유형이고, 그 직간접적 피해 역시도 매우 클 수 있다. 따라서 이러한 농축산물테러를 우리 테러방지법에 명기함으로써 집행부가 해당 유형의 테러에 대하여도 더욱 효율적인 예방활동과 대응활동을 행정적으로 펼칠 수 있도록 하여야 할 것이며, 이를 통해 우리 국민의안전권 역시도 더욱 빈틈없이 보장될 수 있도록 하여야 할 것이다.
Abstract
Terrorism may be classified as a social disaster. In this regard, Article 34 Section 6 of the Korean Constitution stipulates the responsibility of the Korean government to engage in preventing social as well as natural disasters of various kinds, and protecting its citizens from the harm caused therefrom. Thus, it is the constitutional duty of the government to guarantee the safety of the people from terrorist acts and to ensure national security against terrorism. The Counter-Terrorism Law has been enforced since 2016 to carry out the constitutional obligation concretely. Fully considering the mounting threats of terrorism to South Korea by international terrorist organizations, I believe it is a timely and appropriate legislation. Now that the National Assembly representing the will of the South Korean people has created and passed the Counter-Terrorism Law, I feel that comprehensive countermeasures should be taken now to enforce this Law thoroughly at the level of the executive branch. Furthermore, I believe it is the right time to start focusing on reinforcing them from the viewpoint of the law and system in order to enhance the effectiveness of the comprehensive countermeasures. Hence, I would suggest ‘adding the concept of agroterrorism to the definition clause of the Law’ as the legal and systematic way to reinforce the countermeasures in this article. Unlike 「the Public Health Security and Bioterrorism Preparedness and Response Act of 2002」 and 「the Agricultural Bioterrorism Protection Act of 2002」of the U.S., there is lack of consideration on the agroterrorism in the legislation of the Counter-Terrorism Law of South Korea. However, international terrorist organizations can commit agroterrorism at any time without difficulty, and its direct and indirect repercussion will be dire. Therefore, agroterrorism should be stipulated in the Counter-Terrorism Law clearly for the Korean executive branch to prevent and respond to that category of terrorism more efficiently for the full protection of the right of the safety of its citizens.
