국민보호와 공공안전을 위한 테러방지법 개정논의에 대한 고찰

우리나라는 전 세계 유일한 분단국가로서 북한에 대한 군사적 대비와 전쟁도발의 예방만을 생각하고 테러에 대해서는 조금은 소극적인 자세를 유지해 왔다고 볼 수 있다. 그러나 9․11사건을 계기로 우리나라도 테러의 안전국가가 아님을 정부와 모든 국민들이 인식할 수 있는 계기를 만들었다. 테러는 일반 형사범죄와는 달리 잔혹성과 예측불가능성을 통해 국가의 존폐를 결정지을 수도 있는 중대한 범죄이다. 따라서 9․11사건 이후, 테러에 대한 다양한 논의들이 이루어 졌고 특히, 테러에 대한 입법제정 논의가 핵심을 이루었다. 이러한 입법제정에 대한 논의에 따라서 테러방지법 입법안이 발의되었고, 이에 따라 법률제정을 위한 많은 노력들이 이루어졌다. 그러나 제정 법률에 대한 다양한 견해의 차이로 법률을 제정하지 못하고 있었으나 2016년 입법발의안들을 통해 2016년 3월 3일 ‘국민보호와 공공안전을 위한 테러방지법’이 제정․공포되어 시행되고 있다. 그러나 이 법률은 기존의 입법발의안들이 담고 있던 중요 사항들을 모두 입법화하지 못해 이에 따른 입법적 문제들이 지적되고 있다. 따라서 본 논문에서는 2016년 3월 3일 테러방지법이 제정되기 전 입법 발의된 입법안들을 살펴보고, 이러한 입법안들을 통해 테러방지법이 갖는 목적을 재설정하고 국가정보원과 함께 경찰의 역할을 증대시키며 종국에는 국민의 인권보호를 위한 방안을 모색해 보고자 한다.
Abstract
South Korea has established military preparedness and tried to prevent from provoking a war from North Korea as the only ununited nation, thus has kept a passive position about terrorism by other countries. However the government of South Korea and the people got an awareness that South Korea is not safe as well through the 9.11. terror of USA. A terror is a crucial crime that can cause a nation in danger of exist by brutality and unpredictability not like general criminal offense. Therefore, after the 9/11 attacks, there has been diverse discourses about terrorism, and the core is to discuss legislation about terrorism. The anti-terrorism bill was submitted by the legislation discourses, thus there have been a lot of efforts for legislation. Nevertheless the bill was not legislated by the gap of diverse positions about the bills, but the act ‘anti-terrorism for the protection of citizen and public security’ was legislated and has been in effect since third of March in 2016 through the legislation bills. However the act has some legislative problems because of not legislating all the important points of the existing bills. So the paper will check the existing bills prior to the anti-terrorism act of third of March in 2016, find out the problems of the anti-terrorism act, and provide solution plan from them.
