Abstract

In 1970-90, regime changes have taken place all around the world. As the expression of democracy‘s third wave implies, many undemocratic regimes have been changed into democratic ones. The concept of regime change means the ending of an old regime and the introduction of a new one. It brings about, though different in some degree, a fundamental change of the standards and manners of community, which causes many upsets resulting in many political struggles and legal problems. Regime change into a democracy should be carried out in the democratic process compatible with the principle of rule-of-law. In this process the constitutional court plays a very important role because it deals with the matters relative to democracy and rule of law. Both in Hungary and in South Africa, the constitutional courts have been appreciated in that they, following the principle of rule-of-law, actively decided many cases on crimes committed in the previous autocratic regimes and invalidated many unconstitutional acts. The experiences of Hungary and South Africa have taught us the importance of the constitutional court that makes complex political arguments into concise legal issues and delivers a verdict on them. The decisions of the constitutional court have been accepted as manner and means of conflict-solving by politicians and people, which help a new democracy work well. For the better accomplishment of the constitutional court are necessary a neutral institution of selecting judges from various backgrounds and the attitude of acceptance and obedience of decisions by politician. Recognizing the critical function of 'democratic rule-of-law', the role of the constitutional court is still to be required for the more democratic system. This is the same with Korea on the road to the consolidation of democracy.
