공익단체의 공익활동이 우리 생활에서 차지하는 비중은 날로 증대되고 있다. 이러한 현상에 부응하여 법무부는 2010년의 법 개선과제 중의 하나로 “나눔과 기부문화 활성화를 위한 공익신탁법 제정”을 선정하였다. 특히 공익신탁의 활성화를 위하여 공익신탁법제정 특별분과위원회 설치하여 “공익신탁의 설립과 공익위원회의 설치 등에 관한 법률안”의 제정작업을 진행하고 있으며, 올해 법의 날에 이와 관련한 공청회를 개최한 바 있다. 공익활동의 활성화를 위한 공익신탁법의 제정과 아울러 법무부는 기존의 공익활동의 중요한 축을 담당하고 있는 공익법인에 대한 규제체제 정비에 대해서도 개선작업에 착수하였다. 따라서, 조만간 기존 신탁법의 공익신탁편을 대체할 “공익신탁의 설립과 공익위원회의 설치 등에 관한 법률안” 및 공익법인의 기본법인 “공익법인의 설립 운영에 관한 법률”에 대한 통합 혹은 조정 논의가 본격화될 것으로 예상된다. 이 글은 “공익위원회법안”에서 의도하고 있는 공익위원회의 설치, 규제관할, 임무 등에 관하여 살펴보는 것을 그 목적으로 한다. 이 글에서는 (i) 공익단체에 대한 세제혜택의 부여와 공적규제의 정당화, (ii) 기존의 공익단체 규제체제의 현황과 문제점에 대해서 살펴보고, 우리나라에서의 공익단체의 규제를 위하여 공익위원회가 설치되어야 하는 이유 등에 대해서 살펴본다.
Abstract
This article examines the current state of charities regulation and proposes some reforms for better regulation. The article, firstly, looks at the contents of tax-exemptions granted to charitable organizations and suggests that government intervention in charitable affairs should be justified upon the basis of such tax-exempted status. Secondly, some problems arising from the current charity regulation are investigated in detail : why charters for charities are granted too rarely and thus most charitable activities are undertaken by unchartered institutions, what kind of registeration scheme is desirable for encouraging the public to donate more; whether the list of charitable purposes required for qualifying as chartered-charity status is too short. Finally, this paper searches an ideal form of government enforcement of the charitable sector, and argues that establishing a charity commission with the involvement of charitable sector is preferable to granting regulatory powers to present governmental institutions, including tax authority or attorney-general.
