국제인권규약상의 사생활 보호의 권리에 대한 고찰 - UN자유권조약 개인통보문을 중심으로

초록

우리나라 헌법은 사생활의 보호를 기본권의 하나로서 보장 해주고 있다. 하지만 사생활의 개념과 범위에 대한 정의를 내리고 있지는 않다. 그러나 사생활 침해 주장이 있을 경우 논란이 되는 문제 중 한 가지는 과연 사생활의 정의가 무엇이며 그 범위가 어디까지냐는 것이다. 본 논문은 UN 국제 시민적 및 정치적 권리에 관한 규약의 사생활 보호와 관련된 조항을 바탕으로 UN 인권 위원회에 통보된 보고서와 그에 대한 위원회의 결정의 내용을 위주로 사생활의 개념과 범위에 살펴보고자 한다. 이 연구를 통하여 사생활의 개념에 대한 국제 기준을 알아보고 앞으로 이 분야의 연구에 대하여 보탬이 되고자 한다.

Abstract

The Korean Constitution recognises the right to privacy as one of basic human rights and provides protection for the right. However, there is no definition of what constitutes privacy. One of the most contentious issues when it comes to the question of breach of right to privacy is exactly what constitutes the private sphere and its boundaries. This paper examines concept and the limits of privacy in light of the provisions that protect privacy under the International Covenant on Civil and Political Rights and the individual communications made to the UN Human Rights Committee thereunder in order to determine the international standard in assessing the concept of privacy and thereby contribute to the research in this area.
