중국 상표법상 모방상표 등록방지에 관한 연구

Abstract

Generally, while Korean enterprises are more focusing on sales which are seen, they are faced with unexpected problems in trademarks which are not seen. Especially counterfeiting trademark problem is one of a lot of difficulties that Korean enterprises have in China. The higher the awareness of Korean brands will get in China, the more counterfeiting trademark problems will be. It is not permitted to register counterfeiting trademarks in China like in Korea. To cope with difficulties in counterfeiting trademarks, it is important for Korean enterprises to investigate first that whether their trademarks have been registered or not, and if so, how long the trademarks have been used, and whether it is possible to get evidential data or not. The purpose of this study is to give practical help to the executives of the enterprises through relative regulations and related cases when others have applied for patents with counterfeiting trademarks of their own trademarks beforehand or when others have already registered them. Moreover, this study will be a reference for coping with difficulties in counterfeiting trademarks in China and give base line data for counteracting them in case of counterfeiting trademarks issues in China.
