최근 사회적으로 인공지능에 대한 관심이 크게 높아졌다. 법률 내지 분쟁해결 분야 역시인공지능의 활용이 가능한 영역이다. 우리의 경우 이에 관한 학술적 논의가 활발하게 이루어지지 않았지만, 외국의 경우 비교적 오래 전부터 이에 관한 관심과 논의가 지속적으로이루어져 왔다. 아직까지 인공지능의 완성도나 인식이 법률분야에서 적극적으로 활용할 수있는 수준에 이르지 못한 것으로 보이지만 사회의 흐름을 미루어 볼 때, 미래 사회의 다양한 분야에서 인공지능이 활용될 것은 비교적 명확해 보인다. 따라서 우리 역시 이에 관한논의에 관심을 갖고 관련 논의를 진행할 필요가 있다. 현 시점에서는 분쟁당사자의 취사선택이 가능한 온라인분쟁해결절차에서 인공지능의 적극적 활용을 고민해 보는 것이 합리적이라 생각한다. 이에 본고는 다음과 같은 내용에 대해 정리․검토하였다. 첫째, 인공지능과 법 그리고이의 법률분야에서의 활용에 관한 일반적인 내용을 정리․검토하였다. 둘째, 인공지능의한계와 분쟁해결절차상 활용에 관한 내용을 정리․검토하였다. 셋째, 온라인분쟁해결절차상 기술의 활용에 관한 일반적인 내용을 정리․검토하였다. 넷째, 온라인분쟁해결절차상 전문가 시스템을 중심으로 한 인공지능의 활용 현황에 대해 정리․검토하였다. 다섯째, 온라인분쟁해결절차상 전문가 시스템 활용의 고도화를 위한 수단으로써의 법률 온톨로지에대해 정리․검토하였다. 여섯째, 온라인분쟁해결절차상 인공지능의 활용 현황에 대해 간략히 평가하고 향후 고민해야 할 과제를 정리하였다. 일곱째, 온라인분쟁해결절차상 인공지능의 활용에 관한 검토를 토대로 우리 온라인분쟁해결절차의 현황에 대한 간략한 정리와함께 시사점과 향후 인공지능의 활용 가능성과 그 방향에 대해 정리․검토하였다.
Abstract
Recently, many people have started to have an interest in artificial intelligence(AI). AI can be utilized in the field of law and dispute resolutions. We did not actively scholarly discussion of AI. In contrast, foreign countries have been a relatively long discussion about the use of AI. AI is not yet a finished state and the recognition of AI is not too firm. Therefore it seems difficult at this point to take advantage of AI actively in the legal field. However, judging from the flow of society, AI will be used in various sectors of the future society. So we need to be interested in the discussion of AI and to discuss the use of AI in the legal field. At this point, I think it is reasonable to consider the use of AI actively in the online dispute resolution. This article summarized and reviewed the following topics. First, this article summarized the general discussion about the AI and the law, and the use of AI in the legal field. Second, this article reviewed the limitations of AI and the use of AI in the dispute resolutions. Third, this article summarized the general discussion about the use of new technologies in the online dispute resolutions. Forth, this article reviewed the current status of use of AI in the online dispute resolutions, focusing on the expert systems. Fifth, this article summarized the legal ontology as a means for utilizing AI in the online dispute resolutions. Sixth, this article briefly evaluated the utilization of AI in the online dispute resolutions and summarized the future challenges. Seventh, this article reviewed the implications for our systems and the utilization possibilities and directions of AI.
