Abstract

This study analyzes the feasibility of using artificial intelligence (AI), specifically natural language processing(NLP) models such as ChatGPT, in mediation. Mediation is a process of helping conflicting parties reach a mutual agreement, where the neutrality and impartiality of the mediator are crucial factors. In this context, AI has the potential to quickly analyze large amounts of data and offer solutions from an objective perspective. In particular, AI is gaining traction as a revolutionary tool in the mediation process because it can save time and money while maintaining neutrality and support efficient dispute resolution. However, there are also some limitations to using AI. Unlike human mediators, AI lacks empathy, which can be a limitation in building trust between conflict parties. In addition, bias in training data and privacy concerns are major challenges that can undermine the fairness and reliability of AI-based mediation. Furthermore, additional institutional arrangements are needed to ensure that AI meets ethical and legal standards and that accountability is clear. This study presents technical, ethical, and legal options to address these challenges and discusses how AI can complement human mediators in the mediation process and open up new possibilities. In doing so, we suggest that AI-based mediation has the potential to become a fairer and more effective model of dispute resolution.
