Abstract

Marital testimonial privilege is a long tradition of British and American law designed to encourage marital harmony and prevent the natural repugnance of compelling one spouse to testify against another. Both the marital adverse testimonial privilege and the confidential marital communication privilege have utilitarian and humanistic justifications involving the balancing of public and private interests against evidentiary benefits. The Korean legal tradition has acknowledged broad familial privileges as European countries such as Germany, France, and Sweden do. The exceptions to the privilege, “crimes against a spouse” and “joint participant exception,” are applicable to the Korean code of criminal procedure and evidence. In addition, the parent-child privilege would help preserve harmonious family relationships, since positive and open communication is essential to the formation of trust between parent and child. The parent-child privilege is therefore necessary to avoid giving the government unbridled power to encroach on family loyalty and privacy. However, in cases of out-of-control juvenile delinquents, the Korean code of criminal procedure and evidence should provide exceptions to deal with violent, unlawful, or wrongful acts within the family.
