이 논문은 인도네시아-철강 세이프가드 조치 사건을 분석하여, 현재 진행 중인 미국의 무역확장법 제232조와 관련된 WTO 분쟁에 주는 시사점을 도출하고자 한다. 동 사건이 GATT 제19조와 WTO 세이프가드 협정상의 세이프가드 조치의 본질을 이해하는데 시사점을 주는 한편 분쟁패널의 판정권한을 명확히 하는데 일조하고 있다고 평가한다. 먼저, 이 사건의 패널 및 상소기구는 세이프가드의 정의를 검토하여 어떤 조치가 세이프가드로 인정받을 수 있는지 그 요건을 명확하게 했다. 세이프가드로 인정되기 위해서는 동 조치로 인하여 WTO 협정상의 의무가 정지되거나 양허가 철회, 수정되어야 하며, 그러한 조치가 수입급증에 따른 국내 산업의 심각한 피해를 방지 또는 구제하기 위한 명확한 목적하에 취해져야 한다. 설령 국내법적으로 권한 있는 당국이 조사를 개시하고 그 조사결과에 따라 조치를 부과했다고 하더라도 이러한 국내법적인 형식요건이 세이프가드의 실질을 결정할 수는 없다. 한편으로 패널의 임무는 기본적으로 분쟁당사국들이 제출한 패널요청서의 위임사항에 기속되나 패널요청서에 포함되어 있는 사안을 객관적으로 평가하기 위해서는 우선적으로 대상협정이 적용되는지 여부를 판단해야 하고 이에 따라 분쟁당사국이 설령 협정의 적용에 대하여 다른 이해를 하고 있다고 하더라도 분쟁패널이 독자적으로 협정의 적용가능성에 대한 판단을 할 수 있는 권한이 있음을 이 사건은 명확히 밝히고 있다.
Abstract
This paper is to aim at analyzing current WTO case, Indonesia-Safeguard on certain Iron or Steel Products. This paper evaluates this case meaningful due to the following reasons. First of all, this case clarifies the requirements to be recognized as a safeguard measure by panel and AB ruling on the definition of safeguard under Article XIX of the GATT 1994 and Safeguard Agreement. Second, this case confirmed that a panel, under Article 11 of DSU, has a power to perform an independent and objective assessment of the applicability of the covered agreements regardless of whether such applicability has been disputed by the parties to the dispute. This case may also provide some clue to understand the issues raised in the WTO dispute on the tariff measure against steel and aluminum taken by the U.S. under section 232 of the Trade Expansion Act.
