소위 생활동반자법안에 대한 비판적 검토 – 프랑스, 영국, 네덜란드 법과의 비교를 중심으로 –

소위 다양한 가족 형태를 존중한다는 명목으로 노인과 부양자, 비혼 동거 커플, 동성간 결합 등 2인의 생활동반자에 혼인한 배우자와 유사한 혜택을 부여하려는 생활동반자법안들이 진보 진영 국회의원들에 의해 제21대 국회에 발의되었다. 이 법안은 대리 신고를 포함한 간이한 신고로 성립되며 책임 유무를 불문하고 일방 동반자의 해소 신고를 통해서 해소되는 동반자 관계를 제시하고 있다. 그러나, 이 관계는 동성 관계, 근친 관계도 가능한 점에서 현행법제와 저촉되며, 혼인에 비해 안정성이 현저히 떨어져 해소시 당사자의 정서적 재정적 여건에 대한 세심한 고려가 필요하며 자녀의 정서적 고통과 육체적 방임의 가능성이 커짐에도 영국 시민동반자법의 화해 가능성 도입, 까다로운 해소 절차를 고려하고 있지 않다. 이 법이 통과될 경우 동거 문화 확산으로 인한 혼인율 감소, 동거비율 증가와 혼외출생자 비율 증가는 피할 수 없는 결과임은 프랑스, 영국, 네덜란드의 예를 통해 볼 수 있다. 대표적으로 프랑스의 시민결합제도(PACS)는 1999년 동성혼의 대안으로 설계되어 시행되었는데, 이성간 동거도 적용 대상이 되면서 확산되어 2020년 PACS의 95%가 이성간 결합이며, 2021년 전체 출생아 중 혼외출생아 수가 차지하는 비율은 63.5%에 달했다. 출생자 수도 도입 10년 후부터 도입 당시보다 더 감소하는 상황이 지속되고 있다. 혼인 가족관계에 중대한 변화를 가져올 수 있는 법안들이 발의되었는 바, 프랑스법, 영국법 및 네덜란드법상 동반자 관계의 성립, 해소 절차를 비교해 보아 확장적 혼인 개념으로 야기되는 부작용을 살펴 보아야 한다. 국회 계류된 법안 모두 정조의무가 없고, 장혜영 법안은 부양의무와 해소시 양육책임 규정도 결여되어 있다. 가족 관계 기반을 뒤흔들 수 있는 이러한 법안들은 헌법상 양성에 기반한 혼인 가족제도를 보장할 국가의 의무와 현행 법제와 충돌하며 재검토 내지 철회되어야 한다.
Abstract
Two bills on civil partnership were proposed to National Parliament of Korea by a group of progressive congressmen in 2023. Accordingn to two similar bills, civil partnership can be subject to dissolution by one partner’s report of dissolution to local government or a local court regardless of fault, which leads to more unstable relationship than marriage. If a child is born through the civil partnership, the child is more likely to experience emotional pain and neglect due to lack of affinity and shortage of devotion. With basis on research on French, UK and Duth laws on civil partnership, the following results will be expected after either of the two bills is enacted: decrease of marriage and increase of birth influenced by wide-spread of cohabitation culture. Particularly, PACS in France, originally designed as an alternative to same-sex marriage, widened its scope to different-sex partnership and so widely spread that differnet-sex partnership consists of 95% of PACS in 2020, and live births outside of marriage occupied 63.5% of total live birth in 2021. The number of baby-births after ten years of adoption of PACS has decreased below that of baby-births in 2000. Korean bills adopt more convenient measure of establishment and dissolution of a civil partnership than French PACS, Civil Partnership Act of UK and Dutch registered partnership act. The CPA of UK has operated stricter process of dissolution similar to divorce, simillar to Dutch, than French law. Two bills do not have any provisions of preventing close kinship from establishing the partnership, and of imposing duty of chastity. One bill does not have a custody-of-a-child provision in case of dissolution. The two bills, which are outcomes of a relatively short-time consideration, should be strictly and carefully reviewed with concern about potential negative effects on family, possibility of abuse, and contradiction against art.36 of Constitution by National Parliament. Voluntary withdrawals are recommended.
