Abstract
Opt-in, which is a copyright usage method that requires prior permission from the copyright holder to use a copyrighted work, is not suitable for AI training. Therefore, there has been recent discussion about the introduction of opt-out, which allows people to freely use copyrighted works unless the copyright holder refuses permission. Opt-out has recently been legalised by the European Union, and many people in the United States are calling for its introduction. This article examines the feasibility of opt-out as a new paradigm for the use of copyrighted works in the era of artificial intelligence. It concludes that opt-out has no significant impact on the status of copyright holders, is beneficial to AI developers, and is feasible. It then considers how opt-out should be implemented and concludes that the law should provide for copyright holders to opt out of the use of their works in relation to the data mining exemption, and that specific methods could include robot exclusion protocols, contracts and unilateral declarations.
