한국과 일본의 이주민 참정권 제도의 비교 연구: 시민적 공화주의의 제도적 함의

초록

한국과 일본 양국은 오랫동안 단일 민족의 신화와 배타적인 정체성이라는 공통점을 갖고 있었다. 하지만 한국은 최근에는 배타적인 이주민 정책을 폐기하고 아시아에서 최초로 이주민에게 참정권을 부여하였다. 한국과 일본을 사례로 한 이주민 참정권의 비교 연구는 아직까지는 초보단계의 일천한 수준에 머무르고 있다. 어떤 이들은 이에 대해 세계화의 차별적 효과를, 또 다른 이는 역사적, 문화적 요인을 들어 설명하여 왔다. 하지만 본 연구에서 확인한 바로는 정당과 사회운동의 연계와 같은 정치적 요인이 두 국가의 외국인 정책의 차이를 설명하는데 가장 유력한 변수였다. 한국에서는 이주민 참정권을 둘러싸고 개방을 바라는 개혁적ㆍ자유주의적 정당과 시민운동 사이에 광범위한 합의와 강고한 연대가 형성되었다. 또한 그들은 이러한 조치가 인접 국가, 일본에 타의로 건너가게 된 자국 동포의 참정권 보장을 촉진하리라는 합리적 기대를 갖고 있었다. 하지만 일본의 국내 사정은 훨씬 복잡하였다. 이주민 참정권의 허용을 추진하였던 민주당의 응집력과 추진력은 미약한 반면 근 반세기를 집권하였던 패권정당 자민당은 일관되게 허용 논리를 비판하면서 반대 여론을 주도하여갔다. 더 큰 문제는 사회운동 자체의 분열이었다. 민단과 조총련으로 갈라져 반목과 대립이 장기화되면서 이주민 참정권을 추진할 시민사회의 구심력이 약화되었다. 정당과 사회운동의 응집력과 연대의 차이는 왜 한 국가에서는 입법부와 사법부가 이주민 참정권을 놓고 긍정적 상호작용을 하였는지, 그리고 또 다른 국가에서는 반대로 중의원과 최고재판소가 고립된 영역에서 서로 분리되어 있는지를 잘 설명해 주고 있다. 결론적으로, 두 나라의 사례 연구를 통해 본 연구는 정당과 사회운동으로 구성된 정치연합의 성격과 지속성이 이주민 참정권을 비롯한 소수자의 권리 신장에 가장 결정적인 변수라는 사실을 밝혀 냈다. 또한 상이한 이주민 참정권 제도를 창출한 양국의 정치연합은 한국의 공화주의에 기초한 시민주권론과 일본의 국가주의에 기초한 국민주권론의 이념적 토양과 맞물려 있다는 사실을 확인할 수 있었다.

Abstract

This article is a preliminary comparative research on migrants citizens' the rights of electoral participation between Korea and Japan. Korea and Japan had been famous for their exclusive immigration policy. Many scholars pointed out the common features that made two countries discriminatory and closed. That lists included jus sanguinis, ethnical unity and strong nationalism, etc. But Korea are changing their immigration policy from exclusive model to inclusive model which approve Voting Rights for Immigrants. Now, Korea is the only state that enacted enfranchisement of immigrants in Asia. This paper consist of three parts. First, I scrutinize the type and model of voting rights for immigrants in Korea and Japan according to scope and scale. Korea is similar to the nondiscriminatory local right model which permit all immigrants who can satisfy required conditions to voting rights. While Japan belongs to discriminatory model which don't recognize anything at all. Second, this paper overview competing hypotheses which has been said strongly effect on enfranchisement of immigrants. That are birthright citizenship, party of government, power and activity of NGOs and INGO, electoral system(PR). Third, I found the decisive two factors which determined enfranchisement of immigrants between countries. One is diplomatic strategy push for political right for Korean in Japan, another is types of political coalitions. In Korea, political coalitions which consisted of ruling parties, social movements, and immigrants groups move forward with unity and harmony. On the other hand, political coalitions in Japan brought about splits between the parties and social movements. In brief, states have the sovereign authority to determine how they include their resident immigrants in their polities.
