국립경찰의 역사적 전개과정을 통해 본 차기정부의 치안정책 과제

오늘날 어느 국가, 어떤 정부든 안정된 치안의 확보는 국민들의 삶의 질과 관련된 정부의 중요한 역할에 속한다. 그러나 최근 우리사회는 성폭력 범죄 등 흉악범죄 증가로 국민들의 범죄에 대한 불안감이 더욱 커지고 있다. 특히 범죄로부터 취약한 아동과 여성에 대한 민생치안을 강화할 필요가 있다. 민생치안 소홀에 대한 국민들의 우려가 높은 가운데 금년 12월 대통령 선거를 앞두고 각종 정책들이 제시될 것으로 보인다. 본 연구는 국립경찰의 역사적 전개과정을 살펴봄으로써 차기정부의 치안정책 과제를 제시하고자 하였다. 1945년 해방이 되면서 미군정하에 출범한 국립경찰은 대한민국을 탄생시키는 ‘건국경찰’, 6․25전쟁 중에는 ‘구국경찰’로서 활동하여 오늘의 대한민국이 존재하는데 상당한 기여를 하였다. 그러나 국립경찰 출범당시 상당수의 친일경찰로 구성된 태생적 한계를 지니고 있으며, 건국 초기 이승만 정권하에서 체제유지를 위한 정치적 도구로 경찰이 이용되었다. 5․16혁명으로 등장한 박정희 군사정권에서는 안보치안에 밀려 민생치안은 소홀하였다. 12․12사태로 등장한 신군부 정권하에서도 시국치안에 매달려 각종 시위를 진압하는데 우선순위를 두어 인권침해의 역사적 과오를 범하기도 하였다. 그 이후 민간정부들이 들어서면서, 자치경찰제는 실시될 것처럼 보였으나 결국에는 무산되었다. 지난해에는 경찰수사권 조정문제가 본격화되어 수사권관련 형사소송법이 개정되었으나 경찰과 검찰의 갈등관계는 여전히 남아 있다. 이와 같이 해방 후 국립경찰 출범부터 현재에 이르기까지 국립경찰의 역사를 되짚어봄으로써 본 연구는 차기정부의 치안정책 과제로 다음과 같이 제시하였다. 첫째, 성폭력 등 흉악범죄로부터 국민들의 불안감을 줄이기 위한 민생치안활동을 강화하기 위해 더 많은 인력과 예산을 민생치안 부서에 배정하고, 전의경 감축에 따른 부족해지는 경찰력은 보조경찰제도를 활용하고, 경위근속승진제도 시행으로 인센티브가 다소 떨어진 하위직 경찰관들의 조직몰입을 높이기 위한 정책이 필요하다. 둘째, 해방이후 꾸준히 제기되었던 경찰의 정치적 중립성을 보장하기 위해 국가경찰위원회를 설치할 필요가 있다. 그리고 지방행정체제가 개편되는 대로 자치경찰제를 시행하도록 하는 정책과 그 이외 헌법에 경찰의 정치적 중립 조항 신설이 필요하다. 셋째, 형사소송법 개정이후에도 계속되고 있는 경찰과 검찰의 갈등관계를 청산하기 위해 형사소송법상 경찰과 검찰간 상호협력관계를 규정하는 형사소송법 개정이 필요하다.
Abstract
Today, securing a stable peace is the important role of the government. However, due to the increase of serious crimes, including sexual assaults, the anxiety of the people of South Korea is growing recently. Particularly vulnerable children and women from crime it is necessary to reinforce the people's livelihood policing. This study on neglect of the people's livelihood policing concerns of the people of a high ahead of presidential elections in December this year for the next government's policing policy agenda challenges, the process by looking at the historical evolution of the police to propose. Korea's National Police to the birth of the Republic of Korea 'founding the police', 6.25 during the war 'salvation police' in action today as the Republic of Korea there was a significant contribution to. However, during National Police launched a large number of inherent limitations and pro police invited President Lee Syngman's regime as a political tool for the maintenance of the police was used. Since then, Park Chung-hee regime, under the military government and 1980s, the regime for the protection of the new military government current situation giving priority to security of the people's livelihood policing was neglected. Police Investigational earnest last year, and coordination problems related to cases, but police and prosecutors amended the Criminal Procedure Code the relationship of the conflict remains. Thus liberated from the National Police launch to the present result of examining the history of the National Police, security policy challenges of the next government to be suggested as follows. First, to reduce the anxiety of the people to enhance livelihood policing activities more manpower and budget should be put into people's livelihood policing department. Second, after the liberation was raised steadily to ensure the political neutrality of the police state police established a committee to ensure the neutrality of the police need to do. And as soon as the local administrative system reform to the municipal police to enforce a policy that I and the other provisions in the Constitution established the political neutrality of police is required. Third, continuing even after the amendment of the Criminal Procedure Code the police and the prosecution confronts a criminal defense law to liquidate mutual cooperation between police and prosecutors the Criminal Procedure Act amendments to regulations are needed.
