탐정제도를 도입하기 위한 입법화 노력은 거의 20여년을 맞이하고 있다. 탐정제도 입법화의 성패는 사생활 침해의 우려와 전관 유착 및 비리 가능성 등의 반대 논리를 어떻게 극복하느냐에 달려 있다. 국민의 사생활 침해를 심각하게 우려하는 탐정입법화 반대론자들의 기본권 침해 논리를 ‘신 직업’ 등 경제논리로 설득하는 데는 한계가 있다. 탐정입법화 추진은 한 번에 모든 것을 해결한다는 욕심을 버리고, 공인탐정의 업무범위와 관련하여 그동안 주로 검토되어 온 5가지 범주(법률서비스 분야, 보험 분야, 산업(기업)보안 분야, 사이버 분야, 사회안전 분야 등) 가운데어서 국민적 합의가 가능한 업무를 중심으로 일단 제도화하는데 역량을 집중하여야 한다. 전직 경찰 및 검찰 등의 수사경력을 가진 탐정에 대해서는 퇴직 후 일정 기간 그리고 전 근무지 등 일정 지역에서의 탐정업무 금지를 규정하는 개업 제한사항도 규정할 필요가 있다. 경찰업무의 민영화(Privatization of Policing)를 통하여 경찰 전문화를 도모하고, 퇴직자 등 우리 사회의 치안서비스 자원을 최대한 활용한다는 ‘사회 자원의 총동원’ 개념을 이제는 공론화 과정을 거쳐 사회적 합의로 가져갈 시기가 되었다.
Abstract
Legislative efforts to introduce a Private Investigator System have been around for nearly two decades, but have yet to come to fruition. Job prospects for private detectives and investigators are forecast to grow by 11% between 2016 and 2026, according to the U.S. Bureau of Labor Statistics. Moon Jae-in governments have also been given the unemployment rate control policy agenda right at the top of dealing with. Against this backdrop, there is also a formula for 'as a new profession' in the discussion for legislation. It seems to be a new attempt to legislate a system of officially approved detectives that have not been legislated in spite of the economic situation of recession, unemployment and job creation. However, the success or failure of the legislation depends on how to overcome the opposition logic of privacy concerns and collusion with the private sector and possible corruption. The economic logic of those who oppose the legislation, which is seriously concerned about invasion of people's privacy, cannot be persuaded by economic logic. Instead of the desire to solve everything at once, people should focus on the five categories (legal service sector, insurance sector, industrial (business) security field, and social security field) that have been mainly reviewed in relation to the scope of public detective work. A detective with a background in investigations by former police and prosecutors' investigator should also be subject to a new job restriction that bans detective work in certain areas, such as his ex-retirement area. Through the privatization of policing, the police promote the efficient use of police force and specialization in crime prevention and investigation, and our society also takes full advantage of the public security service resources through the experience of retirees.
