토마스 아퀴나스는 <신학대전> Ⅱ-Ⅱ, q.64, a.7에서 이른바 이중 효과 원칙으로 알려진 논변을 제시하고 있다. 정당방위의 문제를 다루고 있는 이 개소는 이중 효과 원칙을 명확한 형태로 제시하고 있는 최초의 사료로 알려져 있으나, 정작 이 개소의 의미 자체에 대해서는 해석이 분분하다. 그런가 하면 이 개소로부터 비롯한 다양한 버전의 이중 효과 원칙은 윤리 신학적 논의만이 아니라 법학적 논의, 생명윤리적 논의에 있어서도 매우 중요한 사고의 틀을 제시해 주고 있기 때문에 다양한 측면에서 면밀한 고찰이 이루어질 필요가 크다고 말할 수 있다. 이 글에서는 위 개소의 해석을 둘러싼 다양한 논의들 중에서 비교적 견해 대립이 뚜렷한 지점들을 찾아 정리하고, 어떠한 해석이 토마스 아퀴나스 자신의 논지를 보다 잘 반영하고 있는지를 검토하고 있다. 이 글에서 이와 같은 견해 대립의 지점으로 생각하고 있는 것들은 첫째, “의도”의 개념에 대한 이해. 둘째, “목적에 대한 비례”의 의미에 대한 이해. 셋째, 자기 방어적 살인이 예외적으로 “허용된다”는 말의 의미에 대한 이해 등이다. “의도”의 개념에 대한 견해 대립은 토마스 아퀴나스의 심리과정론에 대한 이해와 관련이 있으며, “목적에 대한 비례”의 의미에 대한 견해 대립은 특히 “비례주의”에 대한 찬반 논의와 관련이 있다. 그리고 자기방어적 살인이 “허용된다”는 말의 의미에 대한 견해 대립은 오늘날의 도그마틱적 논의와 관련이 있다. 위와 같은 쟁점들을 검토함으로써 이 글에서는 토마스 아퀴나스 자신의 생각과, 이후 신-스콜라주의적 해석론, 그리고 현대적인 “비례주의” 해석론의 유사점과 차이점을 확인하고, 토마스 아퀴나스의 시각에서 위 개소를 이해하는 것이 과연 어떠한 것인지에 대하여 생각해 보고 있다.
Abstract
St. Thomas Aquinas employs the so-called “double effect reasoning” at the second part of the second part of Summa Theologiae. It is known that he explicitly delivered the principle of double effect for the first time, but there has been different versions of interpretation on the exact meaning of the text. It is of great importance to examine various versions of interpretation since double effect reasoning suggests theoretical as well as practical frame of thought against many problems in the fields of theology, law and bioethics. This paper examines mainly three of the key concepts in the text, of which the first is the concept of “intention (intentio)”, the second to be “proportionate to the end(proportionatus fini)”, and the third “to be permitted (licet).”Debate concerning the concept of “intention” must be considered in relation to the theory of the Aquinian process of decision-making, while debate concerning the meaning of the words “proportionate to the end” relates to the estimation of modern proportionalism, and while debate concerning the meaning of the words “to be permitted” relates to the modern dogmatic theory of law. This paper tries to understand the text from the view point of Thomas Aquinas himself and contribute to the continued study and discussion of the legal thoughts of him and his great works.
