법실증주의의 선구자 J. Bentham은 이상주의자인가 혹은 현실주의자인가?

이 글은 이 글은 벤담 Jeremy Bentham(1748~1832)에 관한 필자의 여덟 번째 연구논문에 해당한다. 그 동안 필자가 벤담의 사상과 실천에서의 큰 주제들은 순차적으로 탐구를시도 하였다면, 이제는 한번쯤은 벤담 연구의 중간 정리와 평가를 해야 할 필요가 있다고 생각한다. 이것이 바로 이 글의 동기이자 목적이다. 의심의 여지없이 벤담의 공리성의 원칙과 공리주의 공식은 가장 솔직한 현실의 재료와 상황에서 출발한다. 자연법과 자연권의 축인 ‘가치’와 ‘규범’을 처음부터 끝까지 거부하고 합리적 경험과 과학적 분석만을 자신의 무기로 삼았던 벤담은 과연 가장 극단적인 현실주의자이었을까? 천상의 가치는 존재하지 않는 허구에 불과하기 때문에 현실에서 모두 제거해버리고, 존재하는 실재만을 완벽하게 직시하고 현실에서 고장 난 부분을 깔끔하게 수리할 수 있다는 기획 또는 시도는 오히려 극단적인 이상주의 모습은 아닐까? 벤담의 생각, 사상, 관념, 그리고 이론적이든 실천적이든 제안하고 노력했던 것들의 양상을 이상주의적 혹은 현실주의적 인상에 따라 약간은 도식적으로 정리해보고 가늠해보고자 시도한다. 당시까지 존재하였던 수많은 법학과 법이론에 대한 벤담의 비평과 논증, 그리고 새로이 벤담이 제시하는 주장, 논증, 그리고 체계 등을 현실주의 혹은 이상주의라는 질문을 옆에 두고 점검해보자고 한다. 그렇게 해서 그 동안 작성했던 벤담 관련 논문들과 그것을 준비하면서 번역한 여러 벤담 원전들을 전반적으로 중간 점검할 수 있는 기회를 갖는 것도 조금의 의의는 있지 않을까 생각한다.
Abstract
The aim of this study is to arrange and situate Bentham's critical evaluation of natural rights and natural law, to trace Bentham’s thoughts in his writings and thereby to propose(or gain) some useful perspective of the meaning of the principle of utility, with my question “Is he a realist or idealist?” To give a answer, at least access to the Bentham's evaluation of legal theory and legal reform, it is in its nature necessary to understand and conceptualize the line of Bentham's theory of utilitarianism and political reform program. The line of Bentham's thought, based on ‘utility’, goes in phases further, critique of Common Law - rule(or law) in general - jurisprudence(analytical legal theory) - court and judicial process - legal reform and legislation (legislation and adjudication) - ‘Pannomion’(‘Complete Code of Laws’). Bentham’s particular distaste for Common Law system and natural rights was a starting point of Bentham's theory of legislation which inspired his earliest works. Bentham, in his lifelong academic writings, attacked both the practice and the theory of common law, so much as he tried to constitute a alternative entire system of law and legislation. Bentham's argument and critique of natural rights and natural law theory focused on two problems. First, Bentham's most categorical and damning criticism of natural rights is the claim that they simply don't exist. Second, as his attack to natural rights with the concept of ‘fiction of law’. And Bentham gave his own criticism the title as ‘Nonsense Upon Stilts’. Bentham argued it is impossible to have rights without a government or without law. Ultimately, maybe Bentham attempted to lay the foundation for the plan of the complete body of laws supposing it to be constructed ab origine, according to a method of division grounded on natural and universal principles.
