함무라비 법에 나타난 바벨론의 정체성에 대한 법사학적 고찰

초록

본고는 함무라비 법에 나타난 고바빌로니아 제국의 수도인 도시국가(city-state) 바벨론의 정체성을 법사적으로 고찰한 연구이다. 바벨론은 ‘신들의 문’이라는 뜻으로 함무라비 법의 토대이다. 이 도시는 신들의 보호를 받고, 신들이 새 역사를 열기 위해 출입하는 이상향의 문이라는 의미이다. 바벨론은 우주와 세상 그리고 지하를 연합하는 중심으로 함무라비 법이 추구하는 통치와 가치의 모델이다. 함무라비 법의 전문과 결문에는 수도 바벨론을 중심으로 함무라비에 의해 정복되고 시혜가 베풀어진 여러 도시들의 40여 신들과 신전들에 대한 종교적 치적들이 나열되어 있다. 바벨론은 신들의 도시로서 그 종교는 마르둑 최상권 하의 다종교 통합이다. 바벨론의 이러한종교성 위에 함무라비 법이 세워져 있다. 종교의 본질은 법과 정의이며, 함무라비 법은 샤마시 신으로부터 기인되며 신적 가치를 지닌다. 함무라비 법에 나타난 바벨론의 정체성은 메소포타미아의 종교에 기반을 신들의 회의에의한 법치에 기초되어 있다. 당대 법치의 토대는 천상의 신들의 세계와 지상의 도시국가 그리고 왕권을 총괄하는 질서 위에 세워져 있다. 먼저, 신들의 회의에서 천상과 지상의 최고권의 지위가 마르둑에게 위임되었다. 다음으로, 바벨론은 마르둑의 도시로 존엄하게 명명된 도시이다. 끝으로 마르둑의 대리자로 함무라비가 왕으로 선택되었다. 바벨론은 그의 왕권이 선언되고 정의와 복지가 이루어진 도시이다. 함무라비의 왕권과 통치의 도덕성은 정의와 국리민복에 기초해 있다.

Abstract

This article deals with the issue on the identity of Babylon in the Lawsof Hammurabi with a perspective of legal history. Hammurabi pursued thepolicy of combination of religions and cultures. Babylon is the preeminentcenter of the city-states and religion in Mesopotamia. The identity of Babylonin the Laws of Hammurabi is rooted in the rule of law by the divine councilas the noble city of Marduk endowed with divine kingship under Hammurabi,king of Babylon. Babylon is the place where justice and welfare of the peoplewere achieved. The motifs of divine council and justice in the Laws ofHammurabi seems to be meaningful in human civilization, and are in needof further studies.
