Abstract

In the Ancient Babylonian society, religion contained great meaning and rite played a main role in religion. The temple made every effort to practice rites correctly. However, sometimes the temple could not prevent committing crime during the procedure. The aim of this paper is to know what kinds of crimes existed, what were the special characteristics of crimes and what were the punishments imposed for these crimes and their characteristics based on documents dated from the 7th to the 5th century B.C. The documents coming from Babylonia dated from the 7th century to the 5th century B.C testify that there were various crimes associated with the religion at that time. If we list the names of crimes, we can describe the following : offerings to god made under bad conditions ; forbidden entry to the cella where the divine statue was located ; stealing the holy vessel belonging to god ; teaching sacred knowledge to a non-initiated person ; and not respecting the obligations of purification for the rite. These various crimes reflect the conception of the religion of Mesopotamia in that period. According to these criminal records, rank was important in the Babylonian religion. The temple area was divided according to rank and the accessing of each place was limited according to personal status. If someone did not respect this regulation, he would be punished. This kind of ranking restriction was also applied to knowledge. Knowledge connected with rites was not allowed to be taught to non-initiated persons. If someone taught sacred knowledge to a non-initiated person, he was punished. Studies on the personal status of criminals show us that crimes associated with the religion were committed not only by priests and temple slaves, but also outsiders. However, if we look at ratios, priests committed religious crimes more frequently than temple slaves and outsiders. Temples slaves and outsiders committed crimes at a ratio of 2:1, respectively. Therefore, although we can not disregard the possibility of outsiders committing religious crimes most of the crimes associated with religion were committed by those related to the temple. The documents do not clearly indicate the punishments imposed for crimes associated with religion. However, we can suggest that the punishments were various as the crimes associated with religion were various. The same crime was not punished in the same way. The temple imposed punishment on religious crimes. However, some crimes were punished under royal jurisdiction.
