본 연구는 가정폭력피해여성의 이혼 시 미성년 자녀에 대한 친권자 및 양육권자 결정 경험에 대한 연구이다. 16명의 가정폭력피해여성에 대한 심층면접 자료를 사례연구방법으로분석하였다. 연구결과 발견된 주요주제는 폭력의 유지, 정상가족이데올로기, 가해자의 조건으로 나타났다. 가정폭력피해여성의 친권자 및 양육권자 결정은 가해자와의 접촉과 가해자의 폭력이 유지되는 가운데 진행되었고, 가해자의 협박과 불공평한 협상이 공존하는 장이었다. 정상가족이데올로기는 가정폭력피해여성이 자녀가 성장할 때까지 자녀에 대한 친권 및양육권을 유지하기 위하여 이혼을 유보하거나 가해자의 폭력성보다는 아버지역할을 강조하는 데에 기여하는 것으로 나타났다. 가해자의 조건 중 가해자의 경제력은 자녀의 연령 및 가해자의 자녀학대 여부와 관계없이 가해자의 경제력이 있는 것으로 보고된 사례에 한하여 중요하게 고려되는 것으로 나타났다. 가해자의 조건 중 가해자의 일상적 양육능력은 자녀의 연령이 낮은 사례에서 중요하게 고려되었다.
Abstract
This study explored battered women’s experiences of the custody decisions in the processes of divorce with abusive former partners. Sixteen battered women were interviewed in-depth. Analyzing the data under the qualitative case analysis method, this study found the main themes of battered women’s of child custody decisions as the continuation of domestic violence, the ideology of the normal family, and the conditions of the abusers. Most of the research participants made efforts to achieve sole legal and physical custody of their children against the abusers. Different from the results from existing studies, the co-parenting principle was not the case for battered women in Korea. Battered women made custody decisions in the context of the continuation of domestic violence. The ideology of the normal family hold meaningful effects on their custody decisions.
