본 연구의 목적은 재판상 이혼소송 중 자녀양육권을 주장하는 어머니의 심리적 경험을 연구함으로써 연구 대상이 되는 어머니들의 자녀양육권 주장의 본질과 의미를 파악하는 것이다. 이 연구를 위하여 OO가정법원에 재판상이혼을 청구한 부부 중 초등학생 자녀양육권을 주장하는 어머니 7명을 대상으로 심층면접을 실시하여 수집된 자료를 Colaizzi의 현상학적 연구방법을 적용하여 질적분석하였다. 연구 결과는 다음과 같다. 첫째, 이혼소송 중 자녀양육권을 주장하는 어머니가 심리적으로 경험한 가족관계적 배경으로는 ‘가정은 고통과 복종의 자리’, ‘남편에 대한 증오심’, ‘자녀로 인해 이혼하지 않으려고 인내함’ 등으로 나타났다. 둘째, 자녀양육권을 주장하는 어머니의 심리적 특성으로는 자녀에 대한 공생적(symbiotic) 자기사랑으로 양육에 대해 부담감을 느끼면서도 양육권을 주장하는 것으로 나타났다. 셋째, 이혼소송 중 자녀양육권을 주장하는 어머니가 경험하는 심리적 수용과 새로운 출발로는 ‘상담을 받으며 나를 발견함’, ‘관계의 주체로 타인을 수용함’, ‘꿋꿋한 어머니로 새롭게 출발하기’ 등이 발견되었다. 이는 자녀양육권을 주장하는 어머니들이 부모와 남편에게서 채우지 못한 심리적 공허함을 메우기 위해 자녀를 ‘나’ 처럼 인식하고, 몸부림치며 자녀양육권을 주장하는 것으로 볼 수 있다. 본 연구가 가정법원의 재판상이혼 상담 현장에서 자녀양육권을 주장하는 어머니의 특성을 이해하고, 적절한 상담 개입의 기초자료를 제공하였다는 면에서 법원 관계자나 이혼 상담자들에게 소중한 자료가 될 것으로 기대한다.
Abstract
The purpose of this study was to understand psychological experience of mothers insisting on the child-custody in the process of filing for divorce and figure out the essence and meaning of them. For this purpose, the researcher sampled seven mothers insisting on the child custody in the process of filing for divorce and collected data through in-depth interview. Data collected from 7 participants were analyzed using Colaizzi's phenomenological method. All the statements of participants were recorded, transcribed and analysed qualitatively. The results of the analysis can be summarized as follows. First, family relational background of psychological factors which mothers insisting on child custody in the process of filing for divorce experienced was ‘a concept that family is a field of agony and obedience’, ‘loathing of the husband’, ‘enduring not to be divorced for children’. Secondly, as a psychological characteristic which mothers insisting on the child-custody experience, it is shown that they insist on the child custody under the burden of nurture because of a symbiotic self-love. Third, as psychological embracement and a new start of a mother insisting on the child-custody in the process of filing for divorce, it is found that subject-groups are ‘accepting others as a subject of relationship’, ‘discovering myself as getting counselling’ and ‘restarting as a mother.’ Previously mentioned results represent that mothers insisting on the child-custody recognize their children as themselves to fill out psychological emptiness caused by parents and husbands, and struggle to insist on the child custody. In a regard that this study focused psychological experiences of women who are actually involved with ongoing divorce suits and provided therapeutic data, the result of this research will hopefully give a hand to counselors and lawyers.
