푸펜도르프의 사회성과 아담 스미스의 공감: 홉스의 자연법사상에 대한 비판적 대응

초록

아담 스미스의 도덕철학에서 정의는 공평한 관찰자에 의하여 평가된 다른 사람의 정당한 권리를 침해하지 않는 것이며, 각 개인의 정당한 권리는사회적으로 결정된다. 그러므로 사회적 필요에 근거하여 정부가 시장에 개입하는 것은 정의가 사회적으로 고안된 규범이라는 사실과 모순되지 않으며, 공평한 관찰자는 정의에 일치하는 정부의 개입을 승인한다는 의미에서 정당하다. 이러한 본 연구의 해석은 스미스 당대의 자연법사상과 그의 도덕철학사이의 관계에 대한 새로운 관점을 제공한다.

Abstract

Adam Smith proposed the system of natural liberty as a moral and political structure of commercial society. His argument was read in the literature as economic liberalism which, in turn, had developed into the modern theory of political liberalism. This study presents a different reading. It suggests Smith's whole philosophical discourse as a systematic response to the basic issue of traditional natural law theory. That is, how to resolve the moral tension between political authority and civil liberty. This reading of Smith suggests that political justice is prior to natural liberty, and that government legitimately intervenes into a free market economy for the purpose of social justice.
