애덤 스미스의 법과 경제: 정의와 효율성간의 관계를 중심으로

초록

현대 법경제학에서 정의와 효율간의 관계에 대한 논의는 오랜 논쟁 중인 하나의 현안을 구성한다. 본 연구는 스미스의 학문체계 중 영역은 상이하지만 상호연관 성이 있는 법과 경제의 관계, 또는 정의와 경제적 효율성의 관계를 조명하고자 시 도한다. 그 주요내용은 다음과 같다. 첫째, 스미스는 법의 기초가 되는 정의론을 윤리학의 동감의 이론으로부터 마련하였다. 둘째, 정의의 원리는 국가에 의한 법 과 통치, 즉 국가의 법률체계의 근간이 된다. 셋째, 국가의 실정법 중 정의의 법률 체계는 사람들의 내면적인 정의감정에 입각하여 권리를 보호하기 위해 입법되고 집행된다. 넷째, 정의와 그 법률체계는 경제활동의 배후에서 직접적인 동기가 되 는 사람들의 생활개선 본능과 교환성향을 자극하고 촉진함으로써 효율성을 배가 시키고, 반대로 불의는 그와 같은 사람들의 성향을 제약․억제함으로써 효율을 낮추는 것으로 나타난다. 다섯째, 「법학강의」와 「국부론」에서 거론되는, 사법, 가 족법, 공법을 구성하는 다양한 법률에 대한 비판은 정의와 효율성간의 관계를 매 우 잘 입증한다. 본 연구를 통해 다음과 같은 기존의 연구성과가 더욱 강화됨을 확인할 수 있다. 첫째, 스미스의 사상(思想)에서 정의와 효율성간의 상호 연관관 계를 살펴볼 수 있다. 스미스에게 있어서 정의와 효율의 미시적 또는 사회심리적 토대는 각각 상이함에도 불구하고, 정의와 효율성은 직접적인 연관성을 지닌 것 으로 나타난다. 둘째, 이러한 관점의 연장선상에서 스미스의 사회과학체계에서 나타나는 법과 경제, 또는 더 나아가 윤리와 경제의 긴밀한 관계에 주목할 수 있 다. 법과 정치의 영역은 내면적 윤리영역에 근거를 두면서도 시장과 경제활동에 불가결한 토대로서 기능하며 주요한 제도적 환경을 구성하고 있는 것으로 나타난 다.

Abstract

Recently a relationship between justice and economic efficiency has been one of interesting issues in law and economics. It has also been noted that in Adam Smith’s law and economics, economic efficiency is achieved when justice is sought. This paper tries to shed light upon the close linkage between justice and economic efficiency, in terms of examining some specific cases of private law, family law and public law in the Lectures on Jurisprudence and the Wealth of Nations. The representative cases made in this paper constitute empirical evidence for the theme that a matter of justice ultimately reinforces economic efficiency in Smith’s system of moral philosophy.
