특허 공무원의 전문성 제고를 위한 변리사 자격제도의 개선방안:특허청 경력 공무원의 변리사 자격 자동부여 제도를 중심으로

지식재산권과 특허가 국가경쟁력에 미치는 영향이 커짐에 따라 세계 각국은 특허정책을 국가의 중요핵심과제로 추진하면서, 우수과학기술인력의 유치와 특허행정인력의 전문성 제고를 위해 다양한 유인체계를 구축하고 있다. 한국의 경우에도, 변리사 자격시험 과목의 일부 면제제도를 통해 특허 심사･심판관의 전문성 제고 및 우수인재의 유치를 추진해 왔다. 그러나 심사･심판 인력 중 변리사 시험 응시준비자의 급증으로 인한 업무 부실 가능성, 시험과목 면제에 따른 전문성 하락, 타 시험응시자 및 자격증과의 형평성 등 다양한 문제들이 지적되어 왔다. 이 논문에서는 이와 같은 쟁점들을 종합적으로 고려하면서도, 특허 공무원의 전문성 제고와 변리사 자격제도의 활성화라는 좀 더 넓은 차원에서 특허청 심사･심판 경력자에 대한 변리사 자격 자동 부여제도의 타당성과 제도적 보완책을 검토하고 있다. 즉 특허청 심사･심판 경력자들이 보유하고 있는 전문성을 인정하고 이를 특허 행정의 전문성 제고로 연결하기 위한 변리사 자격 자동 부여제도 환원의 필요성을 검토하였다. 이와 함께, 변리사의 전문성 제고와 변리사 자격의 현장성 강화를 위한 변리사 자격 제도의 개편, 보수교육의 강화, 직무-전문성-자격간 관계의 정교화 등 제도적 보완이 함께 이루어져야 함을 지적하였다.
Abstract
As the impacts of the patents and intellectual property rights on the national competitiveness have been increased, many nations have considered patent policy as top-prioritizing one and revised incentive systems for attracting talented people in scientific fields to patent administration system. In Korea, the career civil servants who have worked for Patent Agency for certain period of time have been partially exempted of some subjects of patent attorney examination. However, there have been some criticisms on the exemption in terms of lowering expertise of the patent attorney, discriminating the general examinees of the test, etc. Considering these criticisms and the development of the patent attorney qualification systems in the future, the author examines the return to the automatic entitlement of the patent attorney qualification instead of the partial exemptions of the subjects. The reasons are as follows: (1) the beneficiaries of the automatic entitlement of the quantification already have expertise that the qualification certifies; (2) the automatic entitlement of the patent attorney qualification will be expected to have better impact for attracting the talented people in scientific fields; (3) it will be helpful to provide better patent attorney services to demanders in the patent services markets. However, the re-adoption of the automatic entitlement of the patent attorney qualification should be accompanied by complimentary measures on the current patent attorney system such as the enforcement of maintenance training for patent attorneys, more sophisticated arrangements among positions in the Patent Agency, career development, and the qualification.
