행정윤리규범으로서의 불편부당성은 공무원이 행정업무를 수행하는 데서 특정 정파나 집단의 이익에 편중되지 않고 국민전체를 위하여 공평무사하게 봉사하는 것이다. 이는 공무원이 준수해야할 중요한 윤리규범으로 책임행정을 구현하는 핵심적 요건이며, 인사행정 면에서는 실적주의의 본질이다. 본 연구는 불편부당성의 하위 범주인 동시에 이를 달성하기 위한 핵심수단인 공무원의 정치적 중립을 둘러싼 논쟁점을 토의하고, 이를 토대로 공무원의 정치적 중립의무를 현실에 적용할 경우의 유의점을 제언하가 위한 것이다. 이를 위해 우선은 행정윤리규범으로서의 불편부당성과 공무원의 정치적 중립의 개념, 필요성, 구성요소 등을 이론적으로 논의하였다. 다음에는 공무원의 정치적 중립을 둘러싸고 발생할 수 있는 논쟁점들을 구체적으로 토의하였다. 마지막으로, 논쟁점들에 대한 토의를 토대로, 공무원의 정치적 중립의무를 현실에 적용할 경우의 유의점들을 논의하였다.
Abstract
Impartiality as the code of administrative ethics is to perform public duties justly without any favoritism toward particular political factions and social groups. Impartiality as a fundamental ethical rule of public administration is a key prerequisite to achieve administrative responsibility as well as the essence of the merit system in personnel administration. The purpose of this paper is to discuss some controversial issues surrounding public servants’ duty of political neutrality, which is not only a sub-category of administrative impartiality but also a core instrument to accomplish impartiality, and to offer some suggestions that require attention in adapting the obligation of political neutrality to the reality. To the end, this paper first examined the concepts, necessities, and proponents of impartiality and political neutrality, and subsequently, debated some controversial issues surrounding public servants’ obligation of political neutrality. A concluding part presented some suggestions to apply the moral and legal obligation of political neutrality to the real world.
