현재 수사과정에서 영상녹화가 종종 실시되고 있는 바, 수사과정에서의 영상녹화제도의 전반에 관한 사항, 즉 영상녹화제도의 도입배경, 경과, 영상녹화 관련 현행 규정, 영상녹화조사의 방식 및 실태, 영상녹화물에 관한 판례의 태도, 영상녹화제도의 개선방향으로서 영상녹화물을 독립된 증거로 인정할 것인지 여부와 영상녹화물을 탄핵증거로 사용할 것인지 여부에 대하여 검토해 보고자 한다.
Abstract
To review whether video recordings could be admitted as independent evidence and whether to use it as proof of refutation by details of video recording system during investigation process on a range of issues, that is to say the background, procedures, the existing provisions on video recording, methods of video recording interrogation as well as its actual status, and attitudes towards the precedent on which video recording was used as video recording has often been implemented during the investigation process these days.
