후견제도의 보완을 위한 신탁에 관한 소고

우리나라의 경우, 후견인으로 선임되는 자의 대부분이 친족이다. 친족이 피후견인의 일상생활, 치료 및 요양 등을 책임지면서 그가 피후견인의 재산을 자신의 재산과 혼용하여 사용하는 경우가 많다. 이로 인하여 피후견인의 피해 사례가 증가하면서 후견인의 재산관리 사무에 대한 법원의 사후적인 감독보다는 예방적인 차원의 대안을 마련할 필요가 있다. 그 대안으로서 신탁제도의 적극적인 활용이 논의되고 있고, 그에 따라 금융기관에서 다양한 신탁상품을 내놓고 있으며, 비영리법인의 신탁사업도 진행되고 있다. 신탁은 전문적인 재산관리 능력이 있는 수탁자를 통하여 재산을 유지 또는 관리하기 때문에 재산권의 수익과 관리의 효용성을 극대화 시킬 수 있는 제도이다. 그리고 이용자가 신탁의 설정방식, 신탁의 내용, 수탁자, 신탁재산의 범위, 신탁재산의 관리방법, 수익권의 내용 등을 자유롭게 정할 수 있어서 다양한 형태로 신탁제도를 활용할 수 있다. 우리나라를 비롯하여 외국의 다양한 신탁제도를 살펴보면 신탁제도의 지속적인 활용가능성 몇 가지를 확인할 수 있다. 첫째, 성년후견과 한정후견에만 성년후견지원신탁을 활용하도록 할 것이 아니라 임의후견에서도 활용할 수 있도록 한다. 둘째, 다양한 수요를 충족하기 위한 특별수요신탁의 도입을 위하여 몇 가지 사항을 고려해야 한다. 셋째, 장애인 특별부양신탁의 제약조건을 개선하여 제도 이용을 활성화시킨다. 넷째, 발달장애인신탁과 같은 사업의 혜택 대상 범위를 확대하도록 한다. 이를 통하여 성년후견제도가 가진 한계를 극복하고, 다양한 계층의 사람들이 신탁을 통해 미래를 안정적으로 설계할 수 있는 기회를 넓히고자 한다.
Abstract
In Korea, most of the people who are elected as guardians are relatives. As they are responsible for the daily life, treatment and medical care of the ward, it is often the case that they use the property of the ward with their property. As the cases of victims due to the misconduct of the guardian are increasing, it is necessary to establish preventive measures instead of the court’s supervision regarding guardian’s property management. As an alternative, the active use of the trust system is being discussed, and various trust products and trust plan of financial institutions are introduced. The trust system can maximize profit of property and utility of management, as the property is managed by professional trustees. And the trust system can be utilized in various forms by allowing the user to choose the method of setting a trust, the content of the trust, trustee, the scope of the trust property and the management method of the trust property. Based on the advantages of the trust system, we look forward to the continued availability of the trust system through a review of several matters. First, we should not only utilize the adult guardianship support trust for adult guardianship and limited guardianship but also utilize them in voluntary guardianship. Second, we should consider introducing the special needs trust. Third, we should expand the tax favor of the special support trust for the disabled and lower the standard of the subscription amount. Fourth, we should provide more people qualified benefits through plans such as trust for persons with developmental disabilities.
