Abstract
The Convention on Cybercrime (Budapest Convention) of the Council of Europe, designed to create the international framework for cybercrime and electronic evidence, requires each Party to enact the necessary domestic legislation for the criminalization of offences against and by means of computers, procedural law tools to secure electronic evidence and for international cooperation. Japan, as one of the Parties, accordingly amended the Penal Code, the Code of Criminal Procedure, etc. Although it promoted the prompt and efficient investigation on cybercrime, the Convention still has issues to resolve, especially on the seizure of computer data across borders. Therefore, the Council drafted the Second Additional Protocol to provide tools for enhanced co-operation and disclosure of electronic evidence, and Japan signed it at the signing ceremony in May 2022. This article discusses the possible changes in investigation caused by the Protocol. It also introduces the Clarifying Lawful Overseas Use of Data Act (CLOUD Act) of the United States, and the Executive Agreement with the United Kingdom, which came into force in October 2022, and considers the prospect of such bilateral executive agreements.
