Abstract
Most of the major industrialized countries have joined the Convention on Cybercrime of the Council of Europe to jointly respond to cybercrime, but Korea has yet to join the Convention. Therefore, this study aims to review the discussion process and current issues of the advanced countries related to the accession of the Cybercrime Convention in the United States, Japan and Canada, and to draw implications for Korea 's accession to the cyber crime prevention treaty. The Convention on Cybercrime has various social and legislative issues such as double criminality, rapid data preservation without warrants, and real-time data interception. However, it occurs beyond the existing criminal justice jurisdictions and it is no longer possible to delay the accession to the Convention in order to effectively respond to the rapidly increasing cybercrime. Therefore, in our case, the implementation of the legislation should be promoted promptly in order to join the Cyber Crime Prevention Convention. In addition, it should review the precedents of the countries that are involved in foreign conventions and promptly implement legislation, and at the same time, prepare measures to ensure the basic rights of citizens.
