Abstract
Traditional mutual legal assistance procedures are characterized by complex processes and significant delays, which limit the ability of law enforcement agencies to obtain electronic evidence in a timely manner. Interpol cooperation, being largely voluntary in nature, is similarly inadequate for securing effective access to electronic evidence. In response to the rapid increase in cybercrime, the CLOUD Act clarified the extraterritorial reach of U.S. law enforcement’s access to data and established a framework under which foreign authorities of a country that enters into an executive agreement with the United States may directly request data from U.S. service providers. The United States subsequently concluded CLOUD Act executive agreements with the United Kingdom in 2019 and with Australia in 2021. If a Korea–U.S. CLOUD Act executive agreement were to be concluded, Korean investigative authorities would be able to directly access data held by U.S. service providers, thereby enabling more expeditious cyber investigations and electronic-evidence collection. However, such an agreement would also enable U.S. law enforcement agencies to request data directly from Korean service providers, raising several concerns. Accordingly, mechanisms capable of effectively controlling foreign orders must be considered. In particular, real-time interception poses heightened risks of rights violations and presents significant challenges for oversight, requiring considerable caution. Moreover, legislative amendments must be undertaken in advance, and the specific provisions of a potential bilateral agreement must be carefully designed. This study analyzes the structure of U.S. federal law together with the background, implementation status, and key provisions of the CLOUD Act agreements concluded with the United Kingdom and Australia. It further identifies the necessity for Korea to conclude an executive agreement with the United States and outlines the considerations that should be taken into account in the course of such negotiations.
