세종특별자치시 설치 등에 관한 특별법 개정 필요성과 특례 모색 방안: 규제 분야 특례를 중심으로

Abstract

The purpose of this study is to discover and propose new special cases in the regulatory field that fit the characteristics of Sejong City in order to secure Sejong City's status as an administrative capital, and to develop a plan to strengthen decentralization special cases and business special cases through this. The purpose is to discuss the direction of revision of the “Special Act on Establishment of Special Self-Governing City” (abbreviated as Sejong City Act). To this end, this study first analyzed the limitations of the Sejong City Act through As-Is Analysis, reviewed the current government's national tasks and policies, and Sejong City's future vision, and also proposed special cases for future projects. In addition to deriving strategic projects for granting, new business special cases were discovered and proposed, and the direction for the revision (draft) of the Sejong City Act was derived. This study focused on discovering special cases focusing on regulatory areas in order to prepare a complete revision (draft) of the Sejong City Act. In addition to the current government's national tasks, 94 special cases that fit Sejong City's characteristics and future vision were discovered and presented. The method of transferring functions through the discovery of special cases was carried out as a comprehensive transfer method, and the transfer of functions was reviewed with a focus on small functions using the function classification system and organizational enforcement rules. As a policy recommendation, this study emphasizes the need to strengthen decentralization special cases and to discover and promote business special cases in parallel. In the future, it was proposed to actively utilize the Sejong City Support Committee to revise the Sejong City Act to appropriately reflect business special cases and decentralization special cases
