Abstract
This paper examines the concept of rights as articulated in Xinmin Shuo (新民說) by Liang Qichao. Focusing on the section titled On the Idea of Rights (論權利思想), the study closely analyzes Liang’s writings on rights and explores the internal logic of his arguments. Liang adopts Jean-Jacques Rousseau’s theories of natural rights and popular sovereignty, understanding rights as expressions of liangneng (良能, innate moral capacity). He argues that the foundation for the protection of rights lies in the very idea of rights itself. Liang presents this idea as being rooted in liangzhi (良知 innate moral knowledge) and liangneng, but the fact that he also speaks of the absence of the idea of rights and the need to acquire rights suggests that rights cannot be fully grasped through liangzhi and liangneng alone. Moreover, Liang links rights to power, asserting that “rights are born of strength” and proposing a logic whereby one must become strong to obtain rights. For Liang, rights go beyond the individual; they are values that contribute to the advancement of the community. This perspective is tied to his concept of national sovereignty (國權), in which the role and effort of the citizen as a constituent of the state are emphasized. In conclusion, while Liang conceptualizes rights as liangzhi and liangneng, he also views them as values that can be acquired. Although the individual’s effort is deemed important in obtaining and expanding rights, this effort ultimately becomes a mere instrument for enhancing national sovereignty—thus exposing a fundamental contradiction. This discussion reflects Liang Qichao’s overarching concern with overcoming the current national crisis through the recovery of national strength.
