秦時“癘者”的刑罰探析與當代價值 ——以睡虎地秦簡為中心

雖然秦簡中關於“癘”的記載不多，但“癘者”刑罰問題仍是一個值得研究的問題。由於史料缺少等問題，仍留下許多值得繼續探究的法律史問題，如睡虎地秦簡中關於“癘者”身份性質、刑罰情形與方法等。對這些問題進行論證分析後，可以發現秦時對待“癘者有罪”會處以“定殺”的嚴刑峻法，但對待不同“癘者”也可能會採用“癘遷所”的隔離救治措施。探析這些問題，不僅有助於更加深入與全面地瞭解兩千多年前的秦代面貌，還為如今面對突發疫情，探索基層防疫制度化、防疫治疫立法化與科學化建設提供了價值啟示。
Abstract
Although there are few records about "Li" in Qin Bamboo Slips, the penalty of "Li zhe" is still a problem worthy of study. Due to the lack of historical materials and other problems, there are still many legal history problems worthy of further exploration, such as the identity nature, penalty situation and methods of "Li zhe" in the Qin Bamboo Slips of sleeping tiger land. After the demonstration and analysis of these problems, it can be found that the Qin Dynasty would impose the severe punishment of "Ding sha" for "those who are guilty of Li zhe", but the isolation treatment measures of "Li qian suo" may also be adopted for different "Li zhe". The analysis of these problems will not only contribute to a more in-depth and comprehensive understanding of the face of the Qin Dynasty more than 2000 years ago, but also provide value enlightenment for exploring the institutionalization of grass-roots epidemic prevention, the legislation and scientific construction of epidemic prevention and treatment in the face of sudden outbreaks.
