이 글은 “합의제 민주주의(Consensual Democracy)”에 맞추어 정치적 의사결정방식으로서의 합의제는 무엇이며, 그것이 현재 민주주의 국가들에서 어떻게 활용되고 있고, 한국의 민주주의에 주는 의미는 무엇인지 살펴볼 목적으로 쓰여졌다. 정치적 의사결정방식으로서 합의제의 정의와 제도적 특성을 관련 문헌들에 나타난 내용을 통해 간략히 정리한 후, 현재 합의제에 가까운 정치제도를 갖고 있는 국가들의 포괄적인 현황을 정리하고, 정치/사회적 분열과 갈등의 해결기제로서 합의제를 채택한 대표적인 국가들로서 스위스와 독일, 그리고 유럽연합의 사례검토를 통해 이들이 왜 이러한 정치적 의사결정과정을 도입하게 되었는지, 이러한 제도적 장치가 이들 국가에서 어떻게 작동하고 있는지 살펴보았다. 논의의 결과, 통상 합의제 민주주의 국가라고 지칭되는 스위스, 독일, 유럽연합에서도 이들이 합의제적 의사결정방식에 기반하고 있지만 현실의 작동에서 효율적인 의사결정을 돕는 보완적 제도들을 구비, 합의제의 문제점을 극복하려는 모습이 발견되었다. 현실의 민주주의 국가들은 두 가지 형태의 의사결정방식을 적절히 혼합하여 각각 의 방식이 갖는 장점들을 살리는 동시에 문제점을 상쇄시키려는 목적으로 정치제도를 구성하고 있으며, 이러한 사실들은 비록 다수제 민주주의와 합의제 민주주의가 이론적 분류의 차원에서 서로 대척점에 존재하는 것으로 논의되지만 현실 세계에 적용되는 과정에서 상호보완적으로 기능하고 있음을 알려준다. 최근 한국정치에서 제기되는 소통의 부재, 정치적 책임성 결여, 사회적 약자의 보호와 같은 비판적 목소리들은 다수제적 의사결정방식을 주로 채택하고 있는 한국의 현실에 합의제적 제도의 도입이 시급함을 보여주는 것이며, 민주화 이후 사회적 갈등과 균열이 다층적으로 변모해가는 우리사회의 모습은 제도개혁의 필요성을 더욱 높여주고 있다.
Abstract
This paper aims to discuss “Consensus Democracy” as a type of political decision-making process both in theory and in practice, and to suggest implications to the democracy in Korea. More specifically, this paper summarizes the characteristics of “Consensus Democracy” and explores its practices with three cases of it. The discussion in this paper shows that typical countries of “Consensus Democracy” indeed try to make up for the problems of its decision-making process with certain types of majoritarian institutions. It implies that majoritarian and consensus types of democracy should be understood as a supplementary way of decision-making process, not as a counter-part. Currently-raised problems in Korean politics such as lack of communication and irresponsible politicians suggest that we need to consider the adoption of consensus decision-making process seriously.
