현대사회는 공공정책 및 사업을 둘러싸고 다양한 공공갈등에 직면해있으며 그러한 갈등의 양상은 점차 심각해지고 있다. 숙의 민주주의 이론은 자유롭고 평등한 시민의 참여와 논증에 의한 숙의를 강조하는 의사결정이론으로서 공공정책 및 사업 등과 관련하여 공공갈등을 예방하고 해결하는 데 중요한 인식을 제공한다. 그러나 현실적으로 공공갈등이 가지는 역동적 성격으로 인해 숙의과정이 왜곡되는 등 갈등해결방법으로서의 기능을 수행하기 어려운 경우도 존재한다. 우리는 국가 및 지방자치단체 차원에서 공론조사, 합의회의, 시나리오워크숍 등의 다양한 숙의적 의사결정방법들을 적용한 바 있다. 이러한 방법들은 결과적으로 공공갈등의 예방 및 해결에 긍정적인 기능을 수행한 경우도 있고 그렇지 못한 경우도 있다. 그러나 아직 그 사례가 충분히 축적되어 있지 않아 우리사회에서 숙의적 의사결정 방법들의 공과를 논하기에는 적절하지 않다. 더욱이 제도화의 측면에서 볼 때 우리사회가 직면한 다양한 불일치의 문제들에 대응할 수 있을 만큼 충분한 규정이 마련되어 있지도 않다. 현재 「공공갈등의 예방과 해결을 위한 규정」이 마련되어 있지만 그 적용대상과 법적 성질 등과 관련하여 여러 한계점이 지적되고 있다. 이에 숙의적 의사결정의 기본원칙, 적용요건, 절차와 효력 등을 규정하는 법률이 마련될 필요가 있다. 또한 숙의적 의사결정의 공정성과 정당성을 확보하기 위하여 절차적, 실무적 측면에서의 연구와 개발이 요구되고 공공갈등의 특성을 고려하여 숙의적 의사결정과정을 지원할 전문인력의 양성도 필요하다.
Abstract
There are many conflicts about public policy and project in modern society. Moreover, such conflicts are getting more and more serious. Deliberative democracy is one of the theory of decision making that emphasizes the participation of ordinary citizens and deliberation by argument. It provides an important ideal for resolving public conflict. However, since public conflict has a dynamic character, it is not always possible to resolve the conflict through a deliberate process. In Korea, deliberate decision-making methods such as deliberative polling, citizens Jury, and scenario workshops have been used at the national and local level. However, a legal system capable of solving various inconsistencies occurring in our society has not yet been established. In order to resolve public conflicts, a law should be enacted that includes the basic principles, requirements, procedures and effects of deliberate decision- making. In addition, administrative agencies should develop procedures and specific methods to ensure fairness and justification for deliberate decision- making. Lastly, in order to resolve public conflicts, they must foster experts who can support the deliberate decision-making process in consideration of the characteristics of public conflicts.
