지방자치단체장과 지방의회의 대립과 갈등은 기관의 목표와 권한, 지위의 특성상 자연스러운 현상이라 할 수 있지만, 이러한 갈등의 양상이 확대되고 서로간의 불신이 깊어진다면 이는 지방자치의 큰 문제로 부각될 수 있다. 따라서 국민에게 봉사하고 지역사회의 발전을 도모하기 위해서라도 양 기관간의 갈등은 상호간의 이해를 바탕으로 토론, 협상과 협의 등을 통하여 해결해 나아가야 한다. 본 연구는 지방의회와 자치단체장과의 갈등 사례를 통해 그 문제점과 해결방안을 갈등발생의 요인을 중심으로 도출함을 목적으로 한다. 즉, 서울시와 서울시의회, 경기도와 경기도의회의 무상급식 사례를 중심으로 양 기관의 갈등의 요인들을 분석 및 도출하고 그 문제점과 해결방안을 제시하였다. 지방의회와 자치단체장의 갈등해결 방안은 이해관계차원, 제도적 차원, 개인적 기술과 자질차원, 업무의 모호성 차원으로 나누어 제시하였다.
Abstract
The conflict and disputes between the head of local government and the local council is natural in terms of their objective, authority and characteristics, but if such is deepened, it could be a great problem. Thus, the conflict must be resolved by means of discussion, negotiation and agreement based on mutual understanding for service to people and for development of local society. This study aims to figure out the problems and solutions based on conflict factors. With the free school meal case between Seoul City government and Seoul City local council and between Gyeonggi-do and Gyeonggi-do council, the conflict factors are analyzed and figured out followed by its solutions. The conflict solution is raised in terms of interest relation level, systematic level, personal technique and characteristics level and ambiguity of work.
