정부갈등의 유형과 해결방법의 특성에 관한 연구: 지방자치단체의 갈등사례를 중심으로

초록

갈등은 항상 존재할 수 있으며 공공갈등 및 정부갈등의 발생은 증가하고 있다. 본 연구는 정부갈등이 정치적 민주화와 지방자치의 실시에 따라 정부갈등, 특히 지방자치단체가 당사자가 되는 갈등의 현황을 유형론적으로 분석하고, 특징을 찾고자 한다. 정부갈등을 갈등의 주체, 내용 및 해결방법을 기준으로 유형화하고 분석한 주요한 특징은 다음과 같다. 정부갈등은 주로 기초자치단체가 당사자가 되는 경우가 대부분이다. 기초자치단체 사이의 정부갈등은 행정관할권과 도로교통과 관련된 갈등, 그리고 광역자치단체 사이의 갈등은 행정관할권과 수자원관리와 관련된 갈등이 상대적으로 빈번히 발생하고 있다. 정부갈등은 자체종결, 제3자 조정 및 당사자 협약에 의해 주로 해결되고 있다. 특히 기초자치단체 사이의 정부갈등은 주로 제3자의 조정이나 중재, 광역자치단체 사이의 갈등은 주로 자체종결, 그리고 정부수준이 다른 정부갈등은 주로 당사자 협약을 통해 해결되고 있다. 정부갈등의 발생과 해결과정에는 여러 요인이 작용하고 있는데, 특히 제3자의 개입과 주민조직화는 많은 갈등사례에서 나타나고 있다. 이러한 요인들은 정부갈등이 제3자의 조정과 중재를 통해 다양한 이해관계를 충족시키고 이성적 해결을 촉진하는 것으로 볼 수 있으며, 한편으로 갈등의 지속기간을 늘리는 요인이 되기도 한다. 본 연구는 정부갈등을 유형화하여 그 특징을 찾고 이해하는 하나의 탐색적 연구로 볼 수 있다. 정부갈등 사례의 부족에 따른 통계적 검증의 필요성은 지속적인 후속 연구를 통해 충족될 수 있을 것이다.

Abstract

Conflicts are widespread in organizations and societies, and public and governmental conflicts are increasingly taking place. This study categorizes and analyzes governmental conflicts, in particular local government-involved ones since the introduction of the local autonomous system in Korea. The types of governmental conflicts are categorized by stake-holders, contents and resolution approaches. Municipalities, so-called basic level of local government in Korea, become conflict stake-holder in most of governmental conflicts, and they are involved in such conflicting issues as administrative jurisdiction and road and transportation management. Provincial and metropolitan governments are chiefly involved in conflicts for administrative jurisdiction and water-resources management. These results clearly imply that local autonomous bodies in Korea have increasingly attempted to defend and boost their own interests. The governmental conflicts are mainly resolved through self-termination of the issues, the third-party mediation and stake-holder agreements. Particularly, the conflicts between municipalities are mostly settled by the third-party mediation, those between provincial governments are by self-termination of issues, and those among governments at different levels are by stake-holder agreements. Also, there are significant factors which have impacts on generating and sustaining conflict circumstances such as organizing local residents and the third-party intervention. The factors also play a role of satisfying interests of various stake-holders, of mediating and arbitrating them, and extending duration of conflicts in most cases. This is an exploratory study to build typologies of governmental conflicts and their resolutions and then to interpret the research results. After accumulating sufficient numbers of governmental conflict cases, future studies are expected to conduct rigorous statistical test.
