국책사업의 절차적 정의와 주민투표: 삼척 원전 건설 분쟁 사례를 중심으로

주민투표제는 분쟁을 증폭시키는 요인이 아니라 분쟁을 해결하는 기제가 되어야 한다. 본 연구는 우선 주민투표제의 효용성을 제고하기 위한 제도적 개혁과 주민투표 관련 심의성의 보완을 강조한다. 더 중요한 것은 절차적 정의와 주민투표제에 대한 인식의 문제이다. 무엇보다도 먼저 ‘국책사업 입지선정 문제에서 주민투표를 궁극적인 해결기제로 활용하는 절차적 정의에 대한 합의’가 선행되어야 한다. 마지막 의사결정 절차는 주민투표라는 점을 강조하여 주민들이 개인적 효능감과 책임감을 동시에 가지도록 해야 한다는 것이다. 특별히 본 연구는 NWFS 가이드라인에 따라 이익 나눔에 대한 현실적 해결책을 강조한다. 이익 나눔은 반대급부적 대가 형식의 경제적 혜택이 아니다. 직접적인 경제적 혜택 외에 해당 지역의 환경적 영향을 환경적 차원에서 선제적으로 보상하는 한편, 비선호시설의 입지에 따른 피해 지역 주민들의 심리적 박탈감을 핌피형 선호시설의 입지를 통해 심리적 차원에서 적극적으로 보상하는 새로운 접근이 필요하다. 건설, 교통, 산업 등 경제적 선호시설은 물론 희소성과 상징성 차원에서 주민들의 심리적 만족감을 높일 수 있는 교육·문화적 선호시설의 우선 입지가 포함되어야 한다는 것이다. 이러한 새로운 틀의 접근이 아니고는 이제 국책사업의 효율적 수행이 어렵다고 본다.
Abstract
Local referendums should be an important dispute resolution mechanism, not an amplifying mechanism. This research puts an emphasis on institutional reforms to enhance the practical utility of local referendums and on the utilization of deliberative devices in relation to referendums. It is essential to reach a consensus first among disputing parties on the procedural justice utilizing a referendum as a final resolution mechanism in order to have the parties, including local voters, feel more individual efficacy and responsibility. This research also lays a special emphasis on some realistic solutions to the problem of benefit-sharing on the basis of NWFS guideline. Benefit-sharing should not be approached as mere economic and financial benefits rewarded in return for the environmental sacrifice of local people; rather, it should be approached from the perspective of environmental compassion and in an affirmative way that takes into account psychological and cultural dimensions as well as economic and financial dimensions. This research notes that a new compassion-oriented framework must be established to make any of national projects like Samcheok nuclear power station realized in the future.
