본고는 현재의 정전협정을 대체하는 한반도 평화협정안을 조문별로 제시하고, 이를 위한 상세한 이론적, 제도적, 실천적 설명을 시도한다. 이를 통해 한반도 비핵화와 정전체제의 평화체제로의 전환, 그리고 북미관계의 정상화라는 세 과제의 동시 실현을 통한 한반도 영구평화의 경로를 모색한다. 평화협정의 당사자로는 한국, 조선, 미국, 중국의 4국을 제안한다. 한국전쟁으로 인한 전쟁상태와 정전상태는 물론 북핵체제 역시 종식되며, 종전선언은 평화협정의 한 조문으로 포함된다. 한국과 조선은 동등한 권리를 갖는 주권국가로서 통일을 지향하는 특수한 정상관계(正常關係)로 설정된다. 한반도에서 핵무기와 무력사용은 영원히 금지되며, 한반도 평화관리 남북공동위원회, 한반도평화관리 국제조정위원회, 한반도 핵통제공동위원회가 항구적 평화를 담보한다. 비무장지대는 평화지대로 전환되며, 구역별로 평화와 화해와 치유의 모범적인 장소로 역할한다. 인도적 문제는 전후처리 특별위원회를 설치하여 해소한다. 평화협정에 저촉되는 내부 법률과 규정들은 자율적으로 개정하도록 한다. 그러나 평화협정은 동맹을 포함한 타국과의 조약에는 영향을 끼치지 않으며 주한미군은 역내 균형자로서 계속 주둔한다. 한반도비핵화의 진전에 조응하여 한국 및 미국과 조선은 각각의 수도에 차례대로 연락사무소, 상주대표부, 공식 대사관을 개설한다. 안보 대 안보의 접근방법이다. 조선 및 중국의 유엔과의 정전상태의 예외적인 장기 지속 역시 종식된다. 요컨대 한반도 평화협정은 한국전쟁으로 인한 한반도문제와 국제관계의 비정상성과 적대상태를 포괄적이며 동시적으로 일괄 해소하는 첩경인 것이다.
Abstract
This paper suggests the full-fledged draft of the Korean Peace Agreement, with very detailed explanations, in order to lay the foundations of a perpetual peace on the Korean Peninsula and in East Asia. This Peace Agreement with the concrete articles aims to end completely both the Armistice Agreement in 1953 and the state of armistice as well. With implementing the Agreement upon the consents of the direct Parties, ―South Korea, North Korea, the USA, and China, ultimately it will pave the way of achieving the three-folded goal,― North Korea’s denuclearization, establishment of the Korean peace regime, and the U.S.-DPRK diplomatic normalization simultaneously. The key point is the mutual recognition of the two Koreas as a complete sovereign state. Then, the building of stable peace is much more important than the pursue of unification between South Korea and North Korea. The Demilitarized Zone must be transformed into the Peace Zone as a global symbolic zone of Pax Consortia and Pax Condominia. With the gradual development of North Korea’s denuclearization process, South Korea and the USA will exchange by stages the liason offices, the standing representatives, and the official embassies with North Korea, at the capitals of the three countries. Signing the Korean Peace Agreement, North Korea and China also will end the exceptional state of armistice with the UN. In sum, the Korean Peace Agreement is the most critical cornerstone for ending conclusively all the long-standing hostilities on the Korean peninsula after the Korean War.
