한반도 평화체제의 재해석: ‘사실상의 평화’라는 시각에서

한반도 평화체제에 대한 논의는 대체로 ‘법적인 평화’, 즉 평화협정 중심으로 이루어지고 있다. 그러나 ‘법적인 평화’는 ‘사실상의 평화’가 뒷받침될 때, 이루어질 수 있고, 그렇게 해야 지속가능하다. 국제적인 평화협정의 사례를 보더라도, 평화협정은 반드시 평화를 보장하지 않는다. 오히려 평화협정이 포괄적이 아니라 부분적이라 하더라도, 사실상의 평화정착 노력을 통해 협정의 모호함을 구체화하는 것이 매우 중요하다. 그래서 우발적 충돌의 가능성을 약화시키고 신뢰를 구축하며 상호인식을 협력적으로 전환해서, 법적인 평화의 불완전성을 보완하는 노력이 중요하다. 평화협정의 당사자 문제도 ‘사실상의 평화’라는 관점에서 재해석할 필요가 있다. 냉전 이후 당사자 문제는 대체로 남북관계의 실질적 발전 수준을 반영하고 있다. 남북관계가 악화되었을 경우 북한은 북미 평화협정을 주장했지만, 남북관계가 실질적으로 개선될 경우에는 대체로 남북 당사자 구도가 정착되었다. 한반도 종전선언과 관련해서도 선언적 의미로 평가하거나, 혹은 이것을 대체하는 포괄적 잠정협정의 필요성을 제기하는 논의도 있으나, 종전선언에서 중요한 것은 법적 의미가 아니라, 그것이 가져올 사실상의 효과다. 종전선언 이후 종전관리체제가 가동된다면 그것은 평화체제 전환까지의 과도기적 국면을 관리하고, 실질적인 평화체제의 제도로 발전할 수 있다. 그리고 한반도 평화협정 체결은 한반도 비핵화 협상, 북·미 관계 정상화, 동북아 평화협력체제 구축 상황 등을 반영하여 추진하는 것이 필요하다.
Abstract
The Korean Peninsula Peace Regime(KPPR) have been mainly discussed on the focus of the ‘de jure peace’, peace agreement. But ‘de jure peace’ could be possible and durable with the 'de facto peace' including the following issue; confidence-building process, developments of the relationship, the change of the mutual recognition etc. Peace Agreement is no guarantee of peace. It is important to make concrete the ambiguity of sensitive issue in the agreement by the efforts of peace-making. On the ‘who would be entitled to participate in negotiating the establishment of KPPR’, the parties to an agreement have been changed by the development of actual relationship between two Koreas. And this article attempts to re-evaluate the meanings of the Declaration of the End of the Korean war. The contents of the declaration may be simple, but the effect can be more complicated. Especially, the declaration might lead to the dissolution of the UN Command. The real effects by the changes from the ‘cease-fire regime’ to the ‘ending war regime’ in Korean Peninsula are more important than the legal force.
