종전선언과 평화협정 2단계 구상의 의미와 과제

‘한반도의 평화와 번영, 통일을 위한 판문점 선언’에서 남북 정상은 “종전을 선언하고 정전협정을 평화협정으로 전환하며 항구적이고 공고한 평화체제 구축을 위한 남·북·미 3자 또는 남·북·미·중 4자회담 개최” 추진에 합의하였다. 관련 당사자들에 의하여 고려되고 있는 한반도 종전선언은 정치적 선언으로, 이 같은 선언이 이루어진다고 하더라도 정전체제로 대표되는 기존의 법질서에 어떠한 변화가 수반되는 것은 아니다. 평화체제 수립 과정에서 정치적 성격의 종전선언이 반드시 필요한 절차는 아니며, 일각의 지적처럼 ‘종전’만을 분리해서 정치적 선언으로 채택하는 것은 오히려 이례적인 경우에 속한다고 볼 수 있다. 그러나 한반도 평화체제 전환 문제는 비핵화 문제와 밀접하게 연동되어 전개되고 있다는 점에서 여타 평화체제와는 상황과 맥락이 다르다는 점이 고려되어야 할 것이다. 일정한 단계를 거쳐 진행될 수밖에 없는 비핵화 과정에 조응하여 종전선언과 평화협정 2단계 구상이 출현한 것이라고 할 수 있다. 즉, 한반도 종전선언은 통상적인 평화프로세스에서 평화예비단계로서의 의미보다는 비핵화 교섭수단으로서의 의미가 더 크다. 따라서 종전선언 문제는 기존의 사례에 비추어 그 적절성 여부를 판단하기보다는 동 선언이 비핵화 교섭수단으로서 어느 정도로 유용한가의 관점에서 검토되어야 할 것이다. 우리 내부적으로는 종전선언과 평화협정 사이에 상당한 시간차가 발생할 경우 남남갈등이 심화될 가능성이 있으며, 종전선언의 국내적 처리 과정에서도 첨예한 논쟁이 예상되므로, 이러한 문제들에 대해서도 고려가 필요할 것이다.
Abstract
In the Panmunjeom Declaration for Peace, Prosperity and Unification of the Korean Peninsula, the two leaders of South and North Korea agreed to actively pursue trilateral meetings or quadrilateral meetings with a view to declaring an end to the Korean War, turning the armistice agreement into the peace agreement, and establishing a permanent and solid peace regime. The declaration to end the 1950-53 Korea War considered by relevant parties is a joint political statement. Such a declaration, therefore, does not entail any changes to the existing legal order represented by the armistice regime. In fact, political declaration terminating a war belongs to a somewhat unusual case. However, it should be emphasized that the peace regime on the Korean Peninsula is closely related to the denuclearization issue, which makes it different from any other peace regime. A two-phased approach of the end-of-war declaration and peace agreement on the Korean peninsula has emerged in response to the denuclearization process, which can be achieved through certain stages. In other words, political declaration terminating a war has meaning as a means of negotiating the denuclearization rather than the meaning of peace preliminaries in the normal peace process. Therefore, it is necessary to review a two-phased approach from the viewpoint of the particularity of the Korean Peninsula rather than merely discussing whether it is proper in light of existing cases.
