주택 공급의 사회적 가치 실현을 위한 제도적 고찰: 사회주택을 중심으로

이 연구의 목적은 사회주택을 중심으로 주택공급의 사회적 가치 실현을 위한 제도를 검토하여 보완 방안을 제시하는 것이다. 현재 우리나라는 사회주택을 규율하는 법률이 존재하지 않는 상황이다. 한편, 서울시와 경기도 그리고 부산시 등은 자체 조례로 사회주택 활성화를 꾀하고 있으며, 적지 않은 시군에서도 조례를 제정하여 사회주택의 공급을 촉진하기 위해 노력하고 있다. 사회주택에 관한 국가 법률은 존재하지 않지만, 지방자치단체의 조례는 존재함으로써 실제 추진 과정에서 불필요한 논쟁이 발생하기도 한다. 이에 이 연구 는 시도 및 시군의 사회주택 활성화 조례를 비교 분석하고, 그 결과를 다시 국가 법률에 대입하여 입체적 으로 분석함으로써 사회주택 활성화의 장애 요인을 찾아내고자 했다. 고찰의 결과, 사회주택 공급자에 관해 규정한 법률의 부재로 논쟁의 소지가 있으며, 사회주택의 임차인 자격도 명확하지 않아 법률적 쟁점으로 부상할 우려가 있음을 확인하였다. 이상의 문제는 모두 특정 계층에 대한 특혜 시비가 사회적 논란으로 부 상한 경험이 있다. 또한, 공동체성 복원과 유지의 관점에서 임대 기한 종료 후 분양 전환의 문제가 법률에 명확히 규정되지 않은 것도 문제로 볼 소지임을 지적하였다. 이 연구는 이상의 고찰 결과를 근거로 제도적 보완 방안을 제시하였다.

Abstract

The purpose of this study is to review the system for housing supply with a focus on social housing for the creating social value and to suggest complementary measures. Currently, there is no law regulating social housing in Korea. Although there is no national law, Seoul, Gyeonggi-do, and Busan are trying to revitalize social housing with their own ordinances. This study tries to find out the barriers to social housing activation by comparing and analyzing the social housing ordinances of provinces and local municipalities, and then substituting the results into national laws to analyze them three-dimensionally. As a result of the review, this study confirmed that there is a possibility of controversy due to the absence of the national law defining social housing providers, and the tenant qualifications are not clear, which may lead to legal issues. In addition, from the viewpoint of restoring and maintaining local community in social housing, this study pointed out that the problem of conversion to sale after the expiration of the lease period was not clearly defined in the law as an issue.
