Abstract
The principle of open justice (public trial) is enshrined in the Constitution. It is based on the ideology of democracy. In a democracy, people may visit the courtroom to see first hand how the law made by their representatives is applied in real cases, and inspect whether judges are conducting their duties fairly and justly. In this context, open justice demands that the court records including judicial documents, evidence, and transcripts be disclosed to the public from the time they were submitted in the open court. The Civil Procedure Act and the Criminal Procedure Act were revised in 2007, so that the court records are available to the public. However, a non-party can apply for the access to the judicial documents only for remedies, academic research and public interest, and access is contingent upon both the court's permission and all the parties' agreement. These conditions make the access to the law almost impractical, far behind the expectation of the open justice principle. In common law countries like the United States, the United Kingdom, and New Zealand, the transparency of the judicial process extends to public access to the court records. Under this principle, court records are presumptively open to the public, unless there are compelling reasons for not permitting access. This article introduces statutes, case laws, and legal theories governing public access to court records in these countries where democracy and rule of law are well established, which shows that judicial transparency serves the ends of justice. By sharing the experiences and discussions of the forementioned countries, we can assess the current situation correctly and set the right direction to take for the purpose of achieving the goal of open justice principle.
