Abstract

The most problematic issue in protection of modern industrial technologies featuring accumulation of improvements is whether and how widely the law protects the functional principle of specific effects or works in industrial technologies(hereafter ‘the functional principle’) In the knowledge-based economy beginning in the 1990s, the core dilemmas of intellectual property protection lie on the scope of protections for softwares which have been the most valuable innovations in industrial technologies since late 20th century. Softwares have two faces which feature similarities in appearances and process of creation with traditional literacy works and discernable differences in performing particular effects like hardwares and easiness of copying. Also software industry has evolved continuously in relation with hardwares and Internet and opens source softwares, interoperability issue as such. During this evolvement, recent fused innovation like smart phones in ICT industries makes softwares more and more important, especially the structure, sequence and organization of softwares(herineafter “SSO”). Consequently, softwares after its advent have changed the scope of protection and features of traditional intellectual property rights like patent, copyright, and design-right and formed the prospect of them. The U.S. current trend which has most developed software industry shows that patent which protected the functional principle in traditional industrial technologies holds a core role to protect SSO of softwares while copyright which gained importance in early times loses more and more its spotlight and design-right gains threshold using GUI designs with this crack. Patent protection of the functional principle of softwares using means plus function claims brings about the concerns of blocking downstream innovations and new entry into software industries around pure SSO and triggers problem of overprotection. This article shows these various developments in traditional intellectual rights like patent, copyright, design-right before and after software advent and industrial evolvement by macroscopic lens focusing on the precedents. Also this article refers to some recent U.S. court opinions like Supreme Court opinion in Alice Corp. v. CLS Bank International(decided on June 17, 2014) to show how U.S. embraces these challenges and changes in softwares and its industry. Another point of this article lies in why intellectual property of Korea has not embraced this innovative process of softwares in SSO focusing on the structure of Korean software industry and problem of intellectual property in protecting the functional principle, which contrasts with the U.S.
