블록체인 기술은 Peer to Peer 네트워크 기술과 암호화에 바탕을 두고, 신뢰받는 중개기관 없이 거래할 수 있는 최초의 분산원장 기술이다. 그런 만큼 파괴적 혁신을 가능케 할 기술로 언급되는 반면 그 산물인 암호화폐는 급속히 한국사회의 심각한 문제로 부각되고 있다. 이 글은 먼저 블록체인 기술의 시초인 비트코인 블록체인과 그에서 파생되어 현재 발전하고 있는 이더리움 등 블록체인 기술의 작동원리와 대강을 살펴보고 블록체인 기술이 파괴적 혁신기술로서 가진 가능성과 한계, 그리고 한국에서의 전망을 살펴보았다. 블록체인 기술 중 현재 단계에서 활용가능한 산물인 암호화폐는 ICO 과정 등을 통해 블록체인 기술 발전에 밀접하게 연관되어 있어 ICO(initial coin offering) 등에 대한 적정범위를 넘는 규제는 특히 현재 블록체인 기술의 발전을 주도하고 있는 공공형 블록체인에 대한 어느 정도의 부정적 영향은 불가피하다. 이러한 상황에서 각 국가는 자신의 상황에 따라 다양한 형태의 규제접근 방법을 취하고 있다. 상대적으로 보면 블록체인 기술의 발원지이고 이를 주도하는 국가로 볼 수 있는 미국은 연방증권위원회(SEC) 등 규제기관 간의 관할을 넘는 협조에 의한 효과적 규제를 통해 암호화폐가 암호화폐 거래소를 통해 일반인에게 투자자산으로 미치는 부정적 영향을 상대적으로 잘 막아내고 있고, 법원은 이러한 규제기관의 입장을 뒷받침하고 있다. 이에 반해 한국의 규제기관은 사실상 무규제 상태에서 암호화폐 거래소를 중심으로 한 급속한 암호화폐의 투기에 가까운 투자자산화 현상을 방임한 측면이 강하다.
Abstract
Blockchain technology based on peer-to-peer network technology and cryptography is the first decentralized ledger technology in which trusted intermediaries are not required to conduct trade. For that reason, blockchain technology is regarded as a destructive innovation. On the other hand, cryptocurrency, which was created using said technology, has rapidly emerged as a social concern in Korea. This paper: (i) examines the operating principle and mechanics of Bitcoin and Ethereum that are powered by blockchain, its underlying technology; and (ii) explores the potential, limits, and prospect of blockchain technology. In as much as cryptocurrency, which is the only available blockchain-based creation, is closely associated with the advancement of initial coin offering (ICO) services, excessive regulation of the same is bound to be somewhat detrimental to furthering the development of public-type blockchain technology. Against this background, countries are taking regulatory approaches befitting their situation. For example, the United States, which is the origin and leader of blockchain technology development, is relatively succeeding in curbing the negative impact of cryptocurrency trading on general investors via effective regulations based on collaboration with the such regulatory bodies as the Securities and Exchange Commission (SEC), and support from the courts. In contrast, the absence of regulatory measures in Korea has played a part in igniting the spark of speculative cryptocurrency investing.
