미국의 pro-patent정책 이후, 특허권 강화가 세계적인 추세로 자리 잡았다. 특허권 강화는 기술시장의 활성화, 기업의 특허활용 확대, 그리고, NPE(특허괴물)라 불리는 새로운 비즈니스의 발전을 촉진하였다. 이러한 변화는 기존에 하나의 대상으로 간주되었던 기술을 사용할 수 있는 능력인 기술력(지식으로서의 기술)과 사용할 수 있는 권리인 기술사용권한(권리로서의 기술)으로 분리했고, 기술력과 기술사용권한을 분리하여 활용이 가능한 체제를 만들었다. 본 연구는 이러한 기술에 대한 접근 개념을 적용하여, 새로운 기술이전 유형의 구분을 제안하는것을 목적으로 한다. 기존의 기술이전에 관한 연구들은 지식으로서의 기술과 권리로서의 기술이 동시에 이전된다고 보았는데, 본 연구에서는 지식으로서의 기술과 권리로서의 기술이 동시에 이전되는 경우, 권리로서의 기술만 이전되는 경우,지식으로서의 기술만 이전되는 경우의 3가지로 기술이전 유형을 구분한다. 그리고 각 기술이전 유형별 차이점과 구분의 의의에 대해 검토하였다. 기술이전 유형에 따라 기술공급자, 기술수요자, 기술이전 목적, 매커니즘 등에 차이가 있음을확인하였고, 이러한 유형구분을 통해 기술이전에 관한 보다 세분화된 연구와 연구영역의 확대가 가능할 것이다.
Abstract
After the pro-patent policy of U.S there has been trends for thestrengthening of patent rights in the world. The strengthening of patentrights makes markets for technology enlarge, patent exploitation of thecompany evolve, the development of the new business model like thepatent-troll accelerate. There is separation between capability to usetechnology and the right to use technology due to the strengthening ofpatent rights. And it is possible to use the former and the latterindependently. The purpose of this study is to propose new types of technologytransfer by applying separated concept of technology in technologytransfer. While there has been many papers on the transfer of thecapability to use technology and the right to use technology at the sametime, there is rare about capability and the right to use technologyseparately. This study suggest three types of technology transfer. Thefirst is the transfer of capability to use technology and the right to usetechnology simultaneously, the second is the transfer of the right to usetechnology, the third is the transfer of capability to use technology. There are many differences-transfer agent, transfer recipient, purpose,mechanism, media, etc-among types of technology transfer. Thissuggestion is expected to review the technolgy transfer in detail andexpand the research area.
