사이버테러에 선제적 대응을 위한 법제 정비에 있어서 모범국가로 볼 수 있는 관련 법제의 제정배경과 주요 내용을 비교ㆍ분석을 하고, 이를 바탕으로 향후 우리나라가 사이버테러에 대한 효과적인 법적 대응체계의 구축을 함에 있어서 우리 실정에 맞는 법령의 제정이나 개정을 위하여 현행 사이버테러 관련 법제의 주요내용을 검토하여 그 개선방향을 제시하는 것이 목적이다. 그러나 사이버테러 관련 법령의 단일화를 위한 특별법 제정은 인권침해의 문제 등이 제기되고 있는 현실을 감안할 때 당장 실현되기는 어려운 것 같다. 따라서 이에 대한 하나의 대안으로 현재 사이버테러에 직접 적용할 수 있는 행정규칙 형식인 훈령으로 존재하고 있는 국가사이버안전관리규정을 법률의 형식으로 개편하는 것도 고려할만 하다. 사이버테러 총괄기구를 국무총리로의 법제화, 컴퓨터 포렌식 등 사이버수사기법의 선진화, 사이버테러 대응을 위한 국제공조, 사이버테러 정책추진을 위한 재원확보, 사이버테러범죄 처벌규정의 신설과 법정형량의 상향조정 등의 사항을 구체적으로 명시할 필요성은 충분히 있다고 생각한다.
Abstract
This dissertation aims to compare and analyze legislative backgrounds and key contents of major foreign countries, which are regarded as exemplary countries in connection with improvement of the legal system for proactive responses against cyber terrorism and suggest improvement strategies, based on the findings, by reviewing key contents of the current legal system related to cyber terrorism for the legislation or amendment of laws suitable for the current circumstances in connection with the future establishment of an effective legal framework against cyber terrorism. However, given the current circumstances where human rights violation has been pointed out as a relevant problem, it appears that a special act that unifies the laws related to cyber terrorism is not likely to be legislated in near future. Hence, as an alternative of the foregoing legislation, it is necessary to consider the modification of the National Cybersecurity Initiative, which is directly applicable to cyber attacks and currently classified as a directive in the form of administrative rule.
