음주운전억제 방안에 관한 실증적 연구 - 경찰활동을 중심으로 -

본 연구는 음주 운전자에 관한 경찰의 법 집행효과에 관한 실증적 연구로 음주운전에 대한 처벌의 제지효과를 분석하여 음주운전근절대책을 강구하고 건전한 교통문화를 확립하기 위한 목적으로 연구한 결과, 설정한 6개의 가설 중에서 3개의 가설이 채택되었고 나머지 3개의 가설은 기각되었다. 여기에 주목할 것은 처벌의 확실성은 음주운전을 억제하는 유일한 변수임이 밝혀졌고 엄격성은 독립적으로 음주운전의 억제요인으로 유의미하지 않다는 사실이 검증되었으며 신속성은 독립적으로 통계적 유의미성이 없는 변수임 확인되었다. 결국, 음주운전 단속전략은 엄격성과 신속성보다는 음주운전을 하면 반드시 적발되고 처벌받게 될 것이라는 확실성을 제고하는 방향의 법 집행활동이 요구되며 나아가 처벌에 대한 확실성, 엄격성, 신속성에 의한 상호작용이 이루어질 때 음주운전의 억제효과를 배가시킬 수 있다는 점을 시사하고 있다. 정책적 함의는 먼저, 경찰의 음주운전 단속전략을 수립하는데 기여할 수 있으며, 둘째 음주운전근절 범국민운동본부 및 위원회를 설치하여 법집행기관과 지역주민이 단속활동에 동참하여 계몽운동을 전개하고, 셋째, 음주운전 삼진 몰수제(삼진아웃제)의 도로교통법을 개정하며, 넷째, 음주운전자에 대한 전문상담 인력을 운용하여야 하겠다. 하지만 본 연구는 조사대상자가 특정지역에 거주한다는 지역적 한계와 표본이 전체 자가운전자를 대표할 수 없다는 점에서 연구결과를 일반화하는데 한계가 있으며 억제변수(확실성, 엄격성, 신속성)가 다른 영향변인 보다 많다는 사실은 음주운전억제효과에 영향을 미치는 변수의 양이 미미하다는 한계를 지닌다. 향후 음주운전억제방안에 관한 연구는 음주운전자의 성격적 특성과 음주운전결정과정의 심리적 특성에 대한 심리학적 혹은 사회문화적 특성 등 다양한 변수가 내포된 심도 깊은 연구가 이루어져야할 것이다.
Abstract
This paper is an empirical study about the effect of law enforcement on drunk driving, and aims to analyze the deterring effect of punishment and to establish sound traffic cultures through enforcement of drunk driving deterrence. Three of six proposed hypotheses have been implemented and another three have been dismissed. The important point to understand is that punishment is the only successful factor in the suppression of drunk driving and rigidity is not a significant factor. Furthermore, celerity is also found to be statistically not significant. The conclusion is as follows. A crackdown strategy is required to enforce traffic laws toward the direction for considering certainty that in case of drunk driving, it will be identified and punished rather than its rigidity and celerity, and the interaction to the punishment by certainty, rigidity, and celerity will be made, the deterring effect of drunk driving will be doubled. Firstly, policy implications can contribute to establishing police crackdown strategy on drunk driving. Secondly, we need a national movement headquarters and special committees for deterring drunk driving for local people as well as law enforcement agencies to come together to coordinate crackdown activities and enlighten the public. Thirdly, edifying manuals about law enforcement for drunk drivers are needed. Fourthly, professional counselling for drunk drivers need to be provided. However, there is a limit to generalizing from the research data due to geographical limit of the samples and the fact that the samples themselves cannot represent the driving public as a whole. In addition, numerous uncontrolled factors such as certainty, rigidity and celerity show that the effect of variables on the deterring effect on drunk driving is minimal. Therefore, research on the deterring effect should also include further studies such as psychological and sociological profiling as well as on the decision-making process factors of drunk drivers to extend the depth of research into this issue.
