2021년 7월 국가와 지방자치단체의 생명ㆍ신체 및 재산을 보호하고 공공의 안녕과 질서유지에 필요한 시책을 수립ㆍ시행한다는 목적에 따라「국가경찰과 자치경찰의 조직 및 운영에 관한 법률 」이 시행되었다. 이에 따라 기존 국가경찰체제는 일원적 자치경찰체제로 전환되었으며, 각 지역별로 시ㆍ도자치경찰위원회가 출범하였지만, 약 2년이 지난 현재 자치경찰제도에 관한 많은 미비점들이 드러나고 있다. 따라서 이 연구에서는 자치경찰제도가 도입된 이후 현재까지 자치경찰법제의 문제점과 시ㆍ도자치경찰위원회 위원 구성의 법률 적합성 등 위원 선정을 비판적으로 검토한 후 발전과제를 제시하였다. 먼저 자치경찰의 운영모델과 미비점을 근거로 자치경찰사무 자체의 특성을 반영한 명확한 법ㆍ제도 마련을 강조했고, 조직체계의 특성을 반영하여 지역경찰을 시ㆍ도자치경찰위원회로 이관할 필요가 있음을 강조했다. 다음으로 시ㆍ도자치경찰위원회 위원 구성의 법률 적합성을 분석한 후 위원의 구성 등 일부 선언적 규정을 강행규정으로 개정할 것을 제안하였다. 또한 시ㆍ도자치경찰위원회 위원의 다양성 확보방안과 시ㆍ도자치경찰위원회 위원의 정치적 중립성을 확보하기 위한 입법적ㆍ제도적 발전과제를 제시하였다. 마지막으로 18개 시ㆍ도자치경찰위원회가 지역주민과 많은 소통을 시도하고 있지만, 이러한 노력들이 실질적인 지역 맞춤형 치안전략으로 시행되기 위해서는 시ㆍ도경찰청과의 원활한 업무협조의 필요성을 제안하였다. 그리고 18개 시ㆍ도자치경찰위원회의 다양한 치안정책을 평가하고 상호 교류할 필요가 있으며, 이를 위해 시ㆍ도자치경찰위원회의 교류 및 협력의 활성화를 강조했다.
Abstract
In July 2021, 「National and Autonomous Police Organization and Operation Act」 came into force according to the aim that the state and local authorities should establish and implement the policies needed for protecting the life, body and property, public security, maintaining the public security and order. Accordingly, although the Autonomous Police Commission has been launched in the regions, some defects related to the autonomous police system are revealed now, two years passed. Therefore, the study analyzed the composition of the Autonomous Police Commissioners and policies since the introduction of the autonomous police system and presented the development issues. First, explaining the operation model for the autonomous police system, the study emphasized the needs of the establishment of the legal system certainly reflected the character of the office work like the investigation in the aspect of the legal system based on the defect of the operation model. It emphasized the change of the office work responsibility reflecting the character of the organizational system. Second, the study analyzed the legal suitability of the composition of the Autonomous Police System Commissioners and proposed to amend the declarative regulation of the composition of the Commission to a mandatory regulation. Also, it suggested the legislative and institutional development issues for the commissioners’ professionality and the political neutrality of the Commission. Last, the study noted that the Autonomous Police Commissions of the 18 local authorities were making efforts to communicate with the local people and suggested that the Autonomous Police Commissions need to cooperate with the Police Agencies smoothly to link the efforts to the implementation of a practical localized security strategy. It needs to evaluate the diverse security strategies of the 18 Autonomous Police Commissions and interact with each other. The study emphasized activating the interaction and cooperation between the Autonomous Police Commissions.
