자치경찰제의 도입은 지역치안행정서비스 질을 최대한 높일 수 있어야 한다. 현재 「정부안」으로 확정되어 있는 기초지방자치단체 수준의 자치경찰제 도입은 주민위주의 자치경찰제가 아니라 국가경찰 위주의 제도라는 점에서 지방자치제의 본질에 어긋날 뿐 아니라 제주특별자치도 자치경찰운영 사례에서 심각한 문제점들이 도출되고 있어 근본적으로 정책방향을 재검토하여야 한다. 자치경찰제를 도입함에 있어서는 최소의 비용으로 질 좋은 지역 및 민생치안서비스가 주민에게 제공될 수 있도록 수요자 중심으로 설계되어야 한다. 이를 위해서는 현행 국가경찰제를 직무를 기준으로 국가경찰과 자치경찰로 나누고, 자치경찰은 시도/시군구 경찰로 구분하여 재배치하는 방안을 가장 우선적으로 고려하여야 한다. 구체적으로는 첫째, 국가경찰은 ‘국가-자치경찰로 개편’하되, 기구‧인력 중 지역치안 담당 기구‧인력을 가칭 시도자치경찰본부로 이관한다. 결과적으로 국가-시도-시군구 경찰간 각각 책임치안을 수행하게 함으로써 국가치안과 지역치안의 전문화를 통하여 주민의 생명과 안전을 획기적으로 보호 하는데 기여할 수 있는 대안이다. 둘째, 자치경찰 사무는 민생 및 지역치안 사무로 하고 가칭 시도경찰본부는 광역지역 치안사무를 담당하고, 가칭 시군구 자치경찰대는 관할구역 내의 민생치안 사무 즉 교통‧지역경비‧방범‧일반범죄수사 지방자치단체의 법집행 사무를 수행한다. 민생치안을 책임지고 담당하게 될 자치경찰은 이와 관련된 수사권 행사가 필수적으로 요구되므로 자치경찰의 수사권 행사범위도 함께 논의되어야 할 것이다.
Abstract
The introduction of municipal police system should be able to improve quality of service of the local police administration possible. Now introduction of municipal police system which is confirmed "the government proposal" based on municipal-level governments is in problems of the case Jeju municipal police system, as well as is only set up a assist police for State police system, not resident-centered municipal police system, so a introduction of policy should be reviewing. In the introduction of municipal police system, with the minimum of cost, region and local policing service should be designed as centered consumers for raising the quality of region and local policing service. To accomplish this, the way that current State police-driven system is redivided State police-driven and municipal police by duty and municipal police share and relocate Si‧do/Si‧gun‧gu Police should be considered a top priority. Specifically, first, national police need to reform 'State-municipal police' and community policing in the organization and personnel part transfer to Si‧do autonomy police headquarters tentatively. As a result, there is an alternative to protect and contribute the lives and safety of residents innovatively through specialization in public safety and community policing and the State-Si‧do-Si‧gun‧gu police carry out policing responsibilities each. Second, the municipal police take charge of livelihoods of the public and community policing office work, Si‧do autonomy police headquarters tentatively assume a wide region policing office work, and Si‧gun‧gu autonomy constabulary unit tentatively carry out community policing office work within the jurisdiction as transportation, regional security, crime, general criminal investigation that is a law enforcement office work of local government. Municipal police which will be in charge of community policing could do with discussion exercise range of municipal police the jurisdiction in the investigation due to essential requirements of the police.
